Michael Goldsmith Obituary

Goldsmith, Michael HEBER CITY, Utah Michael Goldsmith, age 58, of Heber City, Utah died on Sunday, November 1, 2009 at the Hospice Inn at St. Peter's Hospital in Albany after a three year struggle with ALS. Michael was born in Tel Aviv, Israel on March 6, 1951 and spent his childhood in Forest Hills, Queens. He received a B.S. in industrial and labor relations and political science from Cornell University in 1972. In 1975, he obtained a law degree from Cornell Law School. Following law school, he spent one year clerking for United States District Judge, Albert W. Coffrin in Burlington, Vt. He also served as Deputy State's Attorney in Chittenden County, before moving to Washington D.C. to serve as Senior Staff Counsel to the House Select Committee on Assassinations from 1977-1979. The following year he spent as Assistant U.S. Attorney in the U.S. Attorney's Office in Philadelphia, Pa. before turning to the career path for which he was most widely known, that of law professor. Michael taught at Vanderbilt University Law School in Nashville, Tenn., from 1980 to 1983. From 1983 to 1985, he served as counsel to the New York State Organized Crime Task Force in White Plains, N.Y. He directed operations against various mob figures, culminating in his testimony against John Gotti in the late 1980s. Thereafter, he returned to teach, this time, as Professor of Law at Brigham Young University's J. Reuben Clark Law School. He had been voted "Best Professor of the Year" by the student body six times. Devoted to his students, Michael continued to teach even after his diagnosis of Amyotrophic Lateral Sclerosis (ALS). In 1994 President Bill Clinton appointed Goldsmith to the U.S. Sentencing Commission; he served on the Commission until 1998, serving as vice-chairman from 1995 to 1997. After Michael was diagnosed with ALS aka Lou Gehrig's disease he was determined to become an ALS fundraising advocate. While attending a Baltimore Orioles fantasy baseball camp, Michael realized that July 4, 2009 would mark the 70th anniversary of Lou Gehrig's farewell speech at Yankee Stadium. He called on major league baseball to make July 4, 2009, ALS-Lou Gehrig Day. On July 4, 2009, every Major League Baseball park in which a game was being played held on- field ceremonies commemorating Lou Gehrig's famous speech. On that day, in Yankee Stadium, Michael Goldsmith himself threw out the ceremonial first pitch. Michael is survived by his wife, Carolyn Wilson Goldsmith of Heber City, Utah; his mother, Anitta Burg and her companion, George Imperato of Loudonville, N.Y.; his children, Austen and Jillian; his sister Edna Goldsmith and her husband, Tim Fleming of Troy; his sister Lynn Goldsmith and her husband Peter Mark of Newton, Ma. as well as their children Zachary, Ian, Melissa and Allison; and stepsister, Evelyn Burg of NYC. Michael was predeceased by his father, Henry L. Goldsmith; a sister, Debra Goldsmith; and his stepfather, Klaus Burg. Services at the Levine Memorial Chapel, 649 Washington Avenue, Albany, N.Y. on Tuesday, November 3, 2009 at 11:30 a.m. Interment will follow in the Beth Emeth Cemetery in Loudonville, N.Y. Dear Family,
I know, it's many years later; but it's fresh and distressing news to me now, to learn of Mickey's passing. I knew Mickey when I believe he was a visiting professor at Cornell (my memories are vague now) and I was a housemate of his sister, Debra. He came over to the house a few times (1978 or 79), and once made us some kind of garlic soup (and I believe that day he learned the hard way that a garlic bulb is not a clove :-)). We were all in love with him. He was smart, funny, charismatic, so, so handsome and felt to us, even then, larger than life. I see he went on to do important and inspiring work. I still miss Debra, and now I will add Mickey to my frequent thoughts of inspiring and important people in my life. Much love and peace to all of you.

I am the author of BEST EVIDENCE, on the JFK assassination, and a serious student of the assassination. For the past month or so, I have been immersed in the transcripts of Michael Goldsmith's 1978 questioning of various key CIA officials, when he was serving as a staff counsel on the House Select Committee on Assassinations. His questioning was just excellent, so I decided to look him up on the Internet, and write him a letter. I am so sorry to learn of his passing--at the young age of 58. I would love to have interviewed him, and personally congratulated him for a job so well one.

Professor Goldsmith was not only one of the funniest, most memorable teachers I've ever had, but I was particularly impressed by his efforts to prepare a generation of lawyers who would have a positive influence in their communities. Dear Jillian and Austen.
My dear friend Michael was always filled with life, a story and love of the two of you. I remember one evening late while you two were visiting Salt Lake-it was a beautiful summer evening and we were on the grass watching the stars and trying to figure out the constellations. Michael made all of us laugh...he was good at that. He will always be with you. He was loved, admired and appreciated by so many people. You are fortunate to have this man as your dad.

My Friend, Michael Goldsmith touched so many people with his wit, humor and intellect. I will always remember our “Jewish Ski days“, enjoying empty ski slopes on Christmas morning. One Christmas when Michael, Patricia, and I were skiing, Patricia and I had stopped on the side of a ski run, when we noticed two skiers wrestling on the slope. To our surprise, it was Michael and a college aged kid. After the kid skied off, Michael came skiing over yelling; “How did I do?” Michael explained the kid had skied over his skis and after a few choice words, the kid jumped on him. In the middle of the altercation Michael said he realized there was a good chance he had more assets than the kid and in an act of self preservation, Michael pulled the kid’s jacket up over his head so the kid couldn’t see a thing. In Michael’s words “it worked great!” He protected the kid and himself from harm while still looking like he could hold his own with a youngster. To the man who sometimes called himself “BYU’s answer to affirmative action” your inspiration will live on in the hearts of everyone you touched.

I am so sorry about the loss of Michael. I cannot imagine what you are going through, but I lost my mother in 2000 when I was still in college. It gets better over time. Dear Family of Michael Goldsmith,
As a student at BYU, I had the opportunity of meeting Prof. Goldsmith once and it was a few moments that will stick with me forever. Prof. Goldsmith gladly opened his doors to visit when I went in to personally thank him for the work he was doing to raise awareness for ALS. My father has been diagnosed with the same disease and because of the work Michael put forth, my dad found something to work on by continuing the speech reading and throwing the first pitch at a Minor League game in our home town of Boise. It was a great moment for all of us and we had Prof. Goldsmith to thank for it all. He gave me some inspiring advice when I went to visit him and said his door was always open to me. I am very grateful for his kindness he showed me and my thoughts and sympathy are with you. He was a great man.

I am very sad to hear of Michael's death. He was the "turn-to" guy for advice whenever we had a RICO issue in the office. His expert help over the years, most recently just about a year ago, was invaluable. In addition to being a really really smart lawyer, he was a really really nice person. I've known Michael since he came to Utah in the 1980s to teach at BYU. He was a great asset to the law school there as an outstanding classroom teacher and scholar. He also taught on occasion as a visiting professor at the University of Utah S.J. Quinney College of Law. Our students also loved his classes, and he became friends with many members of our faculty and staff. His career exemplified service at its best. His last campaign for ALS research demonstrated his courage, drive, and resourcefulness. I will miss him as a friend, a colleague, and a fellow Orioles fan; and I wish to express deep condolences to his family, friends, students, and the BYU law school community.
