Carl G. Scalise, Sr. Herkimer/Florida
Attorney Carl G. Scalise, Sr., age 84, passed away peacefully on Tuesday, March 6, 2012, in Hallandale Beach, Florida, with his loving family by his side. Carl was born in Herkimer, NY, the son of Frank & Theresa Scalise Italian immigrants who became U.S. Citizens. Carl was educated in the Herkimer Central School System. He received an A.B. Degree from Utica College of Syracuse University and an LLB Degree from Syracuse University College of Law in June of 1956. While in Law School he worked for the college law review and published an article entitled "The Legality of Union Organizational Picketing v. Recognition Picketing in New York State". He was in the military service (U.S. Army) during 1945 and 1947, having charge of as many as 20 to 30 German prisoners on a daily basis at Fort Dix, in New Jersey. He was currently serving our country as a Captain in the Civil Air Patrol and auxiliary of the United States Air Force. He served four years as an apprentice carpenter becoming a full time journeyman. On November 14, 1956, he was admitted to practice law in New York State Courts. On May 25, 1959, he was admitted to practice before the United State District Court, for the Northern District of New York. Carl was admitted to practice before the United state Supreme Court on May 20, 1974. Then on July 26, 1994, he was admitted to practice before the United State Courts of Appeal, Second Circuit. From November 1956 to February 1960, he was associated with the Law Offices of George G. Fiesinger in Little Falls, NY; then from March 1960 to June 2007, he owned and operated his law office in Herkimer. He served as attorney for the Herkimer Housing Authority from March 1, 1990 until June 2007. Carl served as attorney of the Village of Herkimer numerous times through out his career. Attorney Scalise also served as Herkimer town Justice for many years. From January 1, 1965 through June 1969, he served as Research Assistant District Attorney for Assemblyman Donald J. Mitchell, and as Legal Assistant for Congressman Donald J. Mitchell. January 1969 to December 1969, he served as Second Assistant District Attorney for Herkimer County and as Chief Assistant District from January 1970 to July 1976. He was employed as attorney for the Herkimer County Trust Company, Branch office at 319 North Main Street, Herkimer from 1972 to 2000, which he helped establish in 1970. In 1979, he was listed in "Who's Who in American Law". In 1982, he was invited to speak before the Colorado State Bar Association at a joint meeting sponsored by the American Bar Association (all expenses paid) to speak on ethics. He helped 12 young individuals in the legal profession and also employed several young student paralegals. Carl held the following posts of Honor; 1958 Director of Civil Defense Zone #4 Herkimer, 1960 Member of the village of Herkimer Million Dollar Committee, 1964, 1965 & 1966 member of the Board of Directors Utica College Alumni Association, and served on the Taromina Board for many years. He was a member of many social clubs; was president of the Herkimer Rotary Club for one year; Sons of Italy Lodge in Utica: from 1975 to 1992 American Legion, Mohawk Post #25; 1981 to date Free & Accepted Masons, Lodge # 423, Herkimer, in 1988 he served as Master of Herkimer Masonic Lodge, in 1988 he became a 32nd Degree (Scottish Rite) Valley of Utica, and from 1988 to date he was a member of Ziyara Temple # 9194 of Utica. From 1985 to 2002 he was a member of the Ilion Moose Lodge #1010; Herkimer Elks Lodge from 1956 to date. He served on the Herkimer County Community College Advisory Board from 1985 to 1990. From 1989 to 1993 he was a member of the Herkimer County Alternative Measures Board, and in 2010 he became a member of the American Legion in Dania, Florida. In 1960, he established a Real Estate Company later known as Priority One Realty, helping to bring many new businesses to Herkimer. 1969 to 1971, he was a member of Doffan Developers, Inc., a real Estate Developers, and in 1970 until now he was a member of C.R.I.M. Associates, a Real Estate Partnership Holding Company. From January 1989 to September 1993, he was the Administrator of the Herkimer county Assigned Counsel Program for Indigent Defendants. He was appointed as an Alternate delegate to the fifth Judicial District Republican Convention. Although he was a registered Republican, he was appointed by both the Republican and Democratic Mayors to serve as Village Attorney. He helped establish six Legal Precedents: Decker v. Decker, 2AD2d955-12/56:3AD2d808-03/57:8AD2d933-06/59; Village of Herkimer v. Mass. Bonding, 18AD2d94-7/12/77; Simonds v. Simonds, 58AD2d305-7/12/77:45AD2d2333-711/78; DAmbrosio, et al v. Reile, AD Fourth Dept. 12/14/84; Zoeller v. Zoeller (1990); and Carro v. Dryden Mutual insurance Co., 214AD2d1056. On September 7, 1957, he was united in marriage to Dorothy L. Grubner, of East Herkimer, and they have two sons, Carl G. Scalise, Jr. and Ronald J. Scalise and wife, Kimberly, of Herkimer. Carl is also survived by a brother, Frank (Dee) Scalise and wife, Marie, of Naples, Florida; a sister, Nita Bonvino and husband, Anthony (Tony), of Ilion; and two grandchildren, Brittany & Casey Scalise, both of Herkimer. Carl was predeceased by a sister, Mary V. Scalise. Carl could speak, read, and write in Italian fluently, and traveled to Italy and other foreign countries. He had a love for dance that he shared with his wife, Dorothy, as well as a sense of humor that allowed him to tell jokes for hours. A memorial mass will be held on Wednesday, April 4, 2012, at 9:30 a.m. from the Church of Sts. Anthony & Joseph with Reverend Thomas Lawless, Pastor, officiating. Burial will follow at Mt. View Memorial Gardens, Little Falls, NY, with full military honors. Arrangements have been entrusted to the Vincent A. Enea Funeral Service, 329 South Washington Street, Herkimer, NY 866-1500. A celebration of Carl's life will be held immediately following the burial at Franchesca's in Ilion. The family would like to extend an invitation to all friends and relatives.
