DAVID ANDREWS Obituary


ANDREWS DAVID R. ANDREWS A legal pioneer known for forging compromise in court rooms, board rooms and diplomatic circles, died peacefully on December 30, 2013, in Healdsburg, California surrounded by his family. He was 71. Mr. Andrews' career in the legal profession spanned four decades - in both the public and private sectors, throughout the US and globally. He served as the chairman of a large international law firm, senior counsel to three federal agencies and general counsel to a Fortune 50 company. In recognition of his distinguished legal career, Mr. Andrews' alma mater the University of California Berkeley School of Law awarded him the Boalt Hall Citation Award in 2005 for achievements "that have provided leadership to the profession, safeguarded the environment and contributed immeasurably to the peaceful resolution of global conflict." In 2006, based on achievements in both private practice and the public sector, the American Lawyer Magazine selected Mr. Andrews as a recipient of the Lifetime Achievers Award. In 2005 Mr. Andrews retired from PepsiCo, the global food and beverage multinational company where he served as the Senior Vice President for Government Affairs, General Counsel and Corporate Secretary. Prior to joining PepsiCo, Mr. Andrews was a partner at the international law firm of McCutchen, Doyle, Brown & Enersen (now Bingham McCutchen) where he had begun his law practice in 1971. In 1974 Mr. Andrews left McCutchen to serve as the Regional Counsel for the U.S. Environmental Protection Agency (EPA) Region IX. From 1976 to 1980 he served as the Special Assistant for Policy and Legal Counsel to the Deputy Administrator of EPA in Washington, DC. From 1980 to 1981 he served as the Principal Deputy General Counsel to the U.S. Department of Health and Human Services (HHS). At EPA Mr. Andrews earned the Outstanding Service Award and at HHS he was awarded the Secretary's Special Citation. In 1981 Mr. Andrews returned to McCutchen where he started the environmental and natural resources practice, which grew to more than sixty lawyers and became a nationwide and international practice. In 1985 he opened the Washington, D.C. office for McCutchen and served as the managing partner until 1991. He was then elected as the chairman of the firm, the first African-American to lead a major international law firm. In 1997 Mr. Andrews was nominated by President Clinton and confirmed by the Senate to be the 19th Legal Adviser (General Counsel) to the U.S. Department of State, a position he held until April 2000. He was awarded the highest civilian award of the State Department, the Distinguished Service Award, for his work in negotiating a resolution of the dispute between China and the United States over compensation for the May 1999 NATO bombing of the Chinese Embassy in Belgrade. He was also honored for his lead role in the establishment of the Scottish Court that sat in the Netherlands to try the two Libyans accused of blowing up Pan Am flight 103 over Lockerbie, Scotland. During his tenure as the Legal Adviser, Mr. Andrews represented the United States in negotiations with Iran conducted under the Algiers Accords over government-to-government claims arising from the takeover of U.S. property in Iran. At the request of Secretary of State Madeleine Albright and the President, Mr. Andrews continued in that role as the Ambassador (personal rank) and Special Negotiator for Iran/U.S. Claims until January 2001. Service on numerous corporate and non-profit boards of directors were also highlights in Mr. Andrews' career. Recent directorships included Lead Director at Union Bank, a member of the Boards of PG&E Corporation and Pacific Gas & Electric Company, and Presiding Director of the James Campbell Company. Among his affiliations with numerous non-profit organizations, Mr. Andrews served on the Board of Trustees of the Lawyer's Committee for Civil Rights for over thirteen years, the Board of Trustees of the Asia Foundation, and the Advisory Board of the ABA Central European and Eurasian Law Initiative. Born on January 4, 1942 in Oakland, California to David and Mattie Andrews, Mr. Andrews attended the West Oakland secondary schools. Mr. Andrews graduated from the University of California at Berkeley in 1971, and its School of Law, Boalt Hall where he edited the California Law Review. In 1974 (on leave from the McCutchen law firm) he took a position as a visiting Fellow and Professor of Law at the Max Planck Institute for Comparative and Public International Law in Heidelberg, Germany. Mr. Andrews' wife of 52 years, Rozan McCurdy, often accompanied him on his travels. Throughout his career, Mr. Andrews cited his children as his proudest achievement. While he frequently traveled the globe, he called his home his favorite place, where he relished time spent with family and friends. Survivors include wife, Rozan; children, Lynda (Mark Barry), David (Camille) and Debra (Tom); and grandchildren, Evan, Alex, Ian and Aidan. Services previously held. I was Dave's first secretary when he came to McCutchen. I called him "Rookie" and always told him I taught him everything he knows. I wish I had known he lived in Healdsburg as I live in Santa Rosa.
