TERENCE NEY Obituary


NEY THE HONORABLE R. TERENCE NEY Judge Ney was born on July 18, 1944, and died in Philomont, Virginia on November 24, 2014. He was a graduate of Harvard College where he was a member of Hasty Pudding and the DU Club. He received his law degree at the University of Texas at Austin where he was elected to the Order of the Barristers. He started law practice in Fairfax, Virginia in a small firm that eventually became part of McGuireWoods LLP. After thirty years of law practice he was elected to the Circuit Court of Fairfax County where he served as a judge for nearly sixteen years. He was the Editor and chapter author of Appellate Practice - Virginia and Federal Courts from 1986 until the time of his death. Judge Ney taught appellate practice at George Mason University Law School from 2002 until 2012. He was a member of the American Law Institute, a fellow of the American College of Trial Lawyers, a fellow of the American Academy of Appellate Lawyers, a fellow of the Virginia Law Foundation, and a fellow of the American Bar Foundation. He served for six years as a delegate to the American Bar Association and for three years as a member of the Executive Council of Bar Presidents. In 1995 Judge Ney served as President of The Virginia Bar Association. Before becoming a judge, Judge Ney served as a member of the Board of Directors of Loudoun Hospital, was the first president of the scenic preservation group the Snickersville Turnpike Association, and served for many years as General Counsel pro bono for the Philomont Volunteer Fire Department, and the Middleburg Humane Foundation. He loved playing sports. He played competitive tennis in high school and at Harvard and for years with his law partners. He played golf his entire life. He and his wife have been long time members of the Loudoun Golf and Country Club. He also loved music. He played in a rock and roll band at Harvard and for nearly twenty years played mandolin in the Raggedygrass Bluegrass Band. Judge Ney was an avid horseman. He rode horses every week for nearly eighteen years and loved foxhunting. He was a member of the Middleburg Hunt. He was especially proud of the fact that he won two ribbons at the Upperville Colt and Horse Show in the "Silver Foxes" competition. Judge Ney was especially blessed by having a loving family and he had a wealth of friends who enriched his life immeasurably. He is survived by his devoted wife Ursula, whom he adored from the day he met her, their daughter Anja, his daughter Shaler and her husband Bob, his sister Nancy and her husband Carl, and four granddaughters. Funeral services will be held at Truro Episcopal Church on December 15, 2014 at 11 a.m. Interment will be private.

The passage of these six years since Terry's death have not diminished the richness of my memories of him at all. It's like that when someone of such character, intellect, warmth and compassion leaves our lives. I met him as a lawyer, tried cases before him as a judge and considered him a friend. He was a standard setter in every walk of life and it can be said with confidence and conviction that he left this world a better place than he found it on arrival, and very few amongst us can claim that mantle.

I am so sad to hear about Terry's passing. For some reason, I thought about him today even though I had not seen him in a few years. I was shocked to see he had passed. I wish I could have attended the funeral and wish his family the best. Terry was a great and happy person. He always had a glint in his eyes.

I was so sad to hear about Judge Ney's passing. I loved being in his courtroom. He kept everyone on their estimated time during motions day and he appreciated an appropriately dressed and present courtroom. I am really going to miss being a court reporter in his courtroom.

I just happened upon the obituary of Judge Ney. Several years ago I was a jury foremen sitting on a trial that turned into a very difficult case. His honor was an impressive presence in the courtroom, and at the end of the trial, he made the requisite visit to the jury room to speak to us. This same week, I wrote a letter to the Clerk of the Circuit Court expressing my feelings regarding the process of jury selection regarding this case. I received a reply from the clerk who informed me that my letter was being forwarded to Judge Ney; the judge who heard the case. Imagine my surprise when I received a call from the judge's clerk requesting to speak to me. I did return the call, and I can say with confidence, that my concerns were heard, and that His Honor supported my reasoning adding, with prudence, some interesting anecdotes from his many years of sitting on the bench. Regardless of whether my complaints could result in any action, I felt a lot better after speaking to him. That conversation gave me a strong sense of hope and trust in our judicial system in Fairfax County. I know that Virginia has lost a wise and dedicated member of the court as well as a person who seemed to live life to the fullest. My sincere condolences to the Ney family. May found memories and God's grace help comfort you.

My heart breaks to hear the passing of Terry. We loss a kind and generous man. He love his job and always readily available to give you advice on life if you ever need one. He was a great mentor to me and a good friend to myself and my family. Terry married us in December 10th, 2007. The bar has lost a great judge and many of us have lost a dear friend. Terry exemplified what it meant to be called "Judge". Every lawyer I knew who learned that his or her case had been assigned to Terry felt that they had been blessed with a great draw. When counsel for plaintiffs and defendants in civil and criminal cases, without regard to subject matter, feel that way about a judge, as they did Terry, one knew one was in the presence of greatness. Yet, Terry never wore greatness on his sleeve. That he reserved for display of his humanity and awareness of the frailties of the human condition. He was not a distant arbiter of legal disputes, he was an involved listener who required not just all of the evidence, but candid and straight forward discourse with counsel before ruling. A review of his cases on appeal is telling. When he was an attorney and counsel for an appellant, the trial court was frequently reversed. When he went on the trial bench, his decisions were rarely reviewed on appeal [not "Writ" worthy], but, if reviewed, were usually affirmed, a remarkable record, for sure, but then he was a remarkable man.
