HUDSON, N.Y. (AP) - A federal appeals court judge in Manhattan for nearly three decades who was among final candidates President Ronald Reagan considered for the Supreme Court had died. Roger J. Miner was 77.

Paul Silver, a federal prosecutor who once clerked for Miner, says Miner died of heart failure Saturday at his Hudson, N.Y., home.

Miner was appointed to the federal bench in Albany in 1981 by Reagan. He was elevated to the 2nd U.S. Circuit Court of Appeals in 1985. He took senior status in 1997.

His wife, Jacqueline, recalled that he was not chosen for a spot on the Supreme Court after telling the administration that he supported a woman's right to have an abortion. She says afterward that he said he answered the question directly because his reputation was too big a price to pay for a seat on the Supreme Court.

Judge Miner was my night professor at New York Law School for advanced federal criminal procedure in 1988. In three years of law school he was one of the best, his love of criminal law showed and he conveyed that love to his students. Although at the time a federal circuit judge, he was humble and passionate about teaching. Thanks Judge Miner for calling on me every class to recite the facts of the case law reading material. I wanted to express my condolences to the Miner family during this very difficult time. Even in my limited time knowing the judge it was clear
that he was a very thoughtful man who obviously thought the world of his family and I am sure he will be missed.

My condolences to Judge Miners family.I had the privlege of appearing before Judge Miner many years ago in protracted trials in New York Supreme Court and in the Northern District.I found Judge Miner to be wise,considerate of all and possessing a quiet sense of humor that helped everyone get through the day. I have known many fine Judges in my forty plus years of practice and I certainly would rank Judge Miner right at the top.

I never knew him, but I can tell from his obituary that he stood up for his beliefs regardless of if it would affect his job or not. My grandmother always told me that being able to live with oneself is what makes a person successful.
I can tell that Mr. Miner may not have been proud of every decision he made in his life, but I know he was able to live with himself and his mistakes because he trusted God, and people to forgive him above all else. What a remarkable legacy for any human being to leave behind. May God comfort the family during this time of bereavement.
