CECILIA JOHNSTONE Obituary

MADAM JUSTICE CECILIA JOHNSTONE On April 15, 2006, Madam Justice Cecilia Johnstone of Edmonton passed away at the age of 54 years after a lengthy battle with cancer. She lived a life of passion and grace. Cecilia is sur vived by her loving husband, John Day and his children, Jennifer, Jacquie and Olivia; her mother, Anne and her lifelong family friend, Ernie Foss; her brother, Tim and his wife, Ruby; her uncle and aunts and cousins. Cecilia was predeceased by her father, Lawrence in 1962. This extraordinary woman was an accomplished teacher, lawyer and jurist in our community. She was bor n, raised and educated in Edmonton. She received her Bachelor of Arts degree from the University of Alberta in 1973 and her LLB from the Faculty of Law in 1974. Cecilia articled with the then Stratton Lucas firm, to Joseph J. Stratton (later a Justice of the Court of Appeal), and was admitted to the Bar in 1975. She remained with the firm, practicing in the area of wills and estates until her appointment to the Court of Queen's Bench in 1996. She was appointed Queen's Counsel in 1988. Cecilia was a natural teacher. She was course head of the Wills and Estates Bar Admission Course, a member of the Board of Directors for the Legal Education Society of Alberta, a panelist for numerous legal education seminars, a mentor in the Wills and Estates Program and a sessional instructor at the Faculty of Law. Cecilia was a leader at the bar. She was President of the Edmonton Bar Association (1988-89); the first female President of the Alberta Branch of the Canadian Bar Association (1990-91); a member of the American Bar Association; and the National President of the Canadian Bar Association (1993-94). Cecilia courageously championed the fair treatment of women in the legal system and played a major role in the adoption of the recommendations of the 1993 Bertha Wilson Task Force on gender equality. To celebrate her accomplishments in promoting equality in Canada, the Canadian Bar Association honoured Cecilia with the Touchstone Award in 1997. She also received the Distinguished Service Award for the Profession in 1995 from the Law Society of Alberta and the Canadian Bar Association (Alberta Branch). In 2000, she received the first Alumni Honour Award from the University of Alberta, recognizing her service to the community and her significant contribution to the legal profession. Cecilia was devoted to the community. She served as a member of the Board of Directors of Junior Achievement, President of the St. Thomas Moore Lawyers' Guild, President of the Estate Planning Council, Chair of the Board of Directors of the Western Catholic Reporter, Chair of the Northern Alberta Children's Hospital Foundation and then member of the Hospital's Board of Management (now the Stollery Children's Health Centre), Chancellor of Newman Theological College, Chair of the Judges' For um of the Canadian Bar Association and as a member of various governmental advisory committees. Cecilia was a woman well loved by a large circle of family and friends in her community, across the country, and beyond. Cecilia was known for her passionate efforts on behalf of others, whether ensuring underprivileged school children would have Christmas or penning ground breaking family or human rights decisions. We are sad to lose this elegant flame of conviction and compassion. Two years ago St. James Catholic School celebrated its 50th Anniversary. Madame Justice Cecilia Johnstone, an alumni, spoke at the school during our celebration. The staff and the students were inspired by her words. She left her mark on us and we are forever changed.

My condolences to her family and friends.

My late husband, George and I were very priveledged to have instructed the Christoper Leadership Course along with Cec. I admired all her accomplishments in life, while still taking the time to donate time for the benefit of others. My sincerest sympathy to all of her family. She will be dearly missed.

My deepest sympathy to John and to Cecilia's family and those who loved her. She was indeed special. I have many memories of our days together at Stratton-Lucas/Lucas Bowker White. I was Joe Stratton's legal assistant when Cecilia articled to him. That Christmas she gave me a crystal angel - "To my guardian angel". That brought a very close bond during the next years working together. She will be greatly missed but influence goes on forever. With love and sympathy.

I knew Cecilia when she was a very young girl. We were on the Cheerleading Squad together. She was always so bright and cheery with her shock of red hair. She accomplished so much in her life. She will be missed.

To my dearest family, some things I'd like to say...
but first of all, to let you know, that I arrived okay.
I'm writing this from heaven. Here I dwell with God above.
Here, there's no more tears of sadness; here is just eternal love.

Please do not be unhappy just because I'm out of sight.
Remember that I'm with you every morning, noon and night.
That day I had to leave you when my life on earth was through,
God picked me up and hugged me and He said, "I welcome you."

It's good to have you back again; you were missed while you were gone.
As for your dearest family, they'll be here later on.
I need you here badly; you're part of my plan.
There's so much that we have to do, to help our mortal man."

God gave me a list of things, that he wished for me to do.
And foremost on the list, was to watch and care for you.
And when you lie in bed at night, the day's chores put to flight.
God and I are closest to you....in the middle of the night.

When you think of my life on earth, and all those loving years
because you are only human, they are bound to bring you tears.
But do not be afraid to cry; it does relieve the pain.
Remember there would be no flowers, unless there was some rain.

I wish that I could tell you all that God has planned.
But if I were to tell you, you wouldn't understand.
But one thing is for certain, though my life on earth is o'er.
I'm closer to you now, than I ever was before.

There are many rocky roads ahead of you and many hills to climb;
but together we can do it by taking one day at a time.
It was always my philosophy and I'd like it for you too...
that as you give unto the world, the world will give to you.

If you can help somebody who's in sorrow and pain,
then you can say to God at night......"My day was not in vain."
And now I am contented....that my life has been worthwhile,
knowing as I passed along the way, I made somebody smile.

So if you meet somebody who is sad and feeling low,
just lend a hand to pick him up, as on your way you go.
When you're walking down the street, and you've got me on your mind;
I'm walking in your footsteps only half a step behind.

And when it's time for you to go.... from that body to be free,
remember you're not going.....you're coming here to me.
