Philip EPSTEIN Obituary

PHILIP MICHAEL EPSTEIN C.M., O.Ont., Q.C., LLD (h.c.), LSM 'Grandfather of Family Law' Passed away peacefully at home on Sunday, April 4, 2021, surrounded by his family. Devoted and beloved husband of Joyce. Loving father and father-in-law of David and Michelle, Deborah and Aaron, and Sara and Mark. Dear Papa to his eight grandchildren Jeremie, Josh, and Jamie; Ryan, Jake, and Maya; and Elle and Ezra. Proud son of the late Maurice and Esther Epstein. Special son-in-law of the late Sam and Tonia Rapp. Brother and brother-in-law of Jean Vertlieb and the late Arnold Vertlieb. We will greatly miss our guide and all the amazing adventures and laughter we shared. A most sincere thank you to Dr. Gupta and his team at PMH as well as his kind and dedicated nurses Nemia and Joyce. A family service will be held on Tuesday, April 6, 2021. In keeping with his most generous nature and passion for taking care of others, in lieu of flowers, the family kindly requests a donation in honour of Philip be made to The Philip Epstein Memorial Fund c/o Majengo Canada (www.majengo.org), Princess Margaret Hospital (www.thepmcf.ca) or Ve'ahavta (www.veahavta.org).

I regret that I did not have the opportunity to know Phil personally during his life. I did, however, read his newsletter weekly, and I have always been grateful to him for taking the time to pass along his knowledge and experience through these communications. He is an inspiration in family law, and his positive impact on lawyers in the practice (even those like me who never met him) is immeasurable. My deepest sympathy to his family and close ones.

Phil and I go back to March 1986, when I was in the midst of a marital breakup.

Although this was well before his career as a mediator for separating spouses, he had such a fair minded way of acting, that privately I often wondered if he was advising on behalf of my ex wife more than for me.

This was because he rarely and I mean rarely took sides or indulged me in my distress by transferring the blame onto my wife.

He was right in steering me and indirectly my former wife and I toward a better place.

I extend my heartfelt condolences to his family and friends

Phil was a major influencer in my decision to go to law school. He got the ball rolling! I was a Community Legal Worker at an Ontario legal clinic and I was asked to interview Phil for an upcoming provincial newsletter as he was then the Chair of the Clinic Funding Committee. I believe we went for sushi and when I had finished asking my questions Phil said to me “Why don’t you go to law school?” Interesting concept so I thought why not? This was 1988. I had about one month to get everything organized for fall admission. Phil acted as one of my references and I was accepted at Osgoode. That decision changes the course of my life. I will always be grateful to Phil and I wish I had known he was ill as I would have reached out to thank him. So Phil thank you for your generosity and kindness shown to me so many years ago.

An exemplary lawyer when acting for a client (he represented several of my friends), Phil mediated several times for me. He was equitable, thoughtful, appropriately patient and impatient, but above all did the right thing (within the guardrails of the law), and encouraged all concerned to move on in their lives. A compassion that was needed and rare. My condolences to his family, I can only imagine how valuable these qualities would have been to them, and how much that they will be missed.

I had many cases with Phil, especially earlier in my career. I once had 3 or 4 cases on the go with him at the same time. I never tried a case against him but argued motions, had settlement meetings and case conferences with him. I knew him well professionally but not socially. He was the best family law lawyer I ever encountered. He was exceedingly smart and swift, a true Dean of the family law bar. I saw him once on CPAC arguing in the SCC. He had the Supreme Court Justices in the palm of his hand.

I was a "youngish" lawyer, during what was to be one of the most difficult and unpleasant cases of my then short career, when I was given the opportunity to be involved in a mediation and then an acrimonious arbitration case. I told my client this was a once-in-a-lifetime opportunity to learn from the best. I was right. I learned so much about not only family law but exemplary advocacy from Phil. Most of all I learned the value of being a mensch. I will never forget the experience or your contribution to decency and civility in a bar that sometimes needs reminding about these attributes. Rest in peace and may your memory be a blessing.

What an amazing, generous, beautiful man. From simply hearing me on the radio, he championed me, flew me out to Toronto, and had me speak to the family law community. I was so shocked to get this random call from his law firm saying “Phil said you changed his mind and he never changes his mind!” What a lovely person. This summer, his firm donated generously to organizations I chose - far more than expected. He was generous, kind, hilarious. It was a blessing and honour to know him. Like so many, I benefited from his huge heart and spirit.
