R. McMURTRY Obituary

R. Roy McMurtry, O.C, OOnt, K.C, L.S.M, beloved father, grandfather and great-grandfather, died on the evening of March 18, 2024. Dad was a big man. In every way. His professional, political, and judicial accomplishments are well known and documented elsewhere. To his six children he was a loving family man. He will be remembered as a jovial giant by his 12 grandchildren. He delighted in the chaos of the frequent family gatherings, especially at our beloved cottage. While public service was his calling, painting was his passion. He produced thousands of canvases which decorate homes across the country and have been auctioned for various charities. He was a fiercely loyal friend and a ferociously competitive athlete. Dad was born May 31, 1932, to Elizebeth and Roland Roy McMurtry. He is predeceased by his wife, Ria Jean, to whom he was married for 66 years. He is also predeceased by his brothers, William and John; and survived by his brother, Robert. Dad is also survived by his children, Janet, Jim, Harry, Jeannie, Erin and Michael; children-in-law, Ross, Laurie, Deborah, Patti and Chris; grandchildren, Lauren, Marlena, Aidan, David, Devin, Caillin, Thomas, Matthew, Tynan, Callie, Zoey and Kaia; and great-grandchildren, Elliot, Finn, George, Cotty and Bruce. A funeral service will be held at St. James Cathedral, 106 King St. E., on Monday, March 25, 2024, at 2:00 p.m., with a reception to follow. The service will be livestreamed on the Cathedral YouTube channel: https://youtube.com/c/StJamesCathedralToronto Please, no flowers. He was such a good person. In the late 70s I saw him bringing in the Family Law Reform Act and the Mental Health Act, as well as opening the way for legal clinics to give voice to vulnerable communities. These actions helped shift me from skepticism to a standpoint of possibility and the value of positive action. This was big for me and I've always been grateful.

Roy McMurtry´s commitment to democracy and to the rule of law has been pivotal in bringing about positive change for countless people. His staunch efforts as a lawyer and politician, and then as a jurist, has meant that we have, and have been able to rely upon, a meaningful Charter of Rights and Freedoms. Years after the Charter came into effect, as Chief Justice, he courageously ensured that the principles of the Charter were upheld, even when his personal values might have been challenged.

To have been able to work with him in establishing the Ontario Justice Education Network was an experience second to none. The chambers of Osgoode Hall often reverberated with dialogues he initiated with youth and community representatives, and he quietly made a point of going out into communities, especially to listen to young people.

He so often opened doors for others where none had existed. He sought to hear voices that would otherwise go unnoticed. Recognizing inherent frailties in our society, he strove to strengthen our democratic institutions at each turn.

It is not surprising that someone who lived such a meaningful life was a vibrant painter. His life expressed in so many ways. Through his last years, his hand-penned notes continued to encourage and show appreciation. May Roy McMurtry´s multiple legacies be carried on by many. My deepest condolences to his family members.

My sincere and heartfelt condolences to Janet, Jim, Harry, Jeanie, Erin and Michael. I have many fond memories of growing up on Lascelles Blvd with the McMurtry clan. We spent a lot of time playing outside and it was always a special treat to have Mr. McMurtry take time out to throw a football to all of us with a big grin on his face.
Mrs. McMurtry was also very kind and welcoming. I am so sorry to learn of her passing as well. My heartfelt sympathies to you all.

I first met Roy in the early ‘60s and, with my late husband Norman Dyson, shared many pleasant evenings with both Rita Jean and him - in Toronto, on legal excursions of one kind or another, and in London when he was High Commissioner. Following the trajectory of his achievements and years of commitment to public service over the years has been meaningful and inspiring. May he rest in peace.

I had the privilege of practising law with Roy's son, Harry, for many years and this led to the privilege of meeting Roy on a few occasions. For someone so accomplished, he was a remarkably humble and also very kind and generous. It was my honour and pleasure. To spend professional and social time with Roy during our time together in London England . I was a Canadian banker and he was High Commissioner. We spent many late Friday afternoons at MacDonald House recapping the week with cigar and port in hand.

I remember since the 1980's, how publicly he attended events and spoke. One was at Ryerson another at Osgoode Hall. He really held it together helping with Chief Judge Andrews work with kids and William Davis work with Catholic charities. He did reach out and was readily available to speak. I particularly liked his work supplying an art box to the textile Museum where I did volunteer work. Amazing contribution to our country and city.
