JOSEPH GREEN Obituary

GREEN, Joseph Benjamin Of Cambridge, Massachusetts, passed away on August 17, 2022 at 74 from pancreatic cancer. An accomplished attorney and tennis player, Joe was known for his integrity and agility, both in court and on the court. Born in 1947 in New York City, Joe attended Horace Mann School for junior high and high school, followed by Yale University, where he majored in American studies. Upon graduation in 1969, he completed one year at Harvard Law School. He then took a four-year hiatus, during which he served on the Washington, D.C. police force and won a grant from the National Endowment for the Humanities to study the French police. But, as it turned out, the French police did not want to be studied. All was not lost, however, as he met his future wife, Carol (a fellow New Yorker), in Paris, where she had been working as a textile designer. After embarking on a three-month backpacking trip through Southeast Asia, Joe and Carol returned to the United States, and he completed the last two years of Harvard Law School, graduating in 1976. Shortly after his law school graduation, Joe and Carol married. Together they have three children, Jeff, Ariana, and Nick. Jeff and his husband, Adam, live in Scottsdale, Arizona, and have two sons, Zac and Ethan. Ariana and her husband, Sam, live in Scarsdale, New York, and have three children, Jella, Jake, and Ezra. Nick lives between New York City and Cambridge, where he has been assisting with Joe's care since his diagnosis. Joe's law career spanned over 40 years, beginning when he joined Hutchins & Wheeler, a Boston law firm. Always drawn to public service, he left private practice and spent the next decade serving as Chief District Court Prosecutor and Director of Policy and Planning for Essex County, Massachusetts. In 1989, Joe returned to private practice, joining the Boston law firm of Kotin, Crabtree & Strong, and soon became a partner. His practice areas included special education, personal injury, criminal law, and disability rights. In addition, he authored a book and several articles on evidence, trial practice and procedure, and criminal law. Outside of the office, Joe was an advocate for disability rights and served on the board of the Massachusetts Branch of the International Dyslexia Association. Joe was an avid tennis player. He played every Tuesday evening with a steady group of friends for more than 30 years and was a loyal member of the Cambridge Tennis Club, where he also served on the board. He and his son Nick won the father-son doubles championship in 2009. He also won the men's doubles championships in 2002 and 2006. Joe always looked forward to his weekly golf outings, which occurred on the many Wednesday afternoons he and his golf group took off from work to hit the links. In addition to the local greens, they also enjoyed traveling to play courses across the United States and in other parts of the world. Joe was a beloved son of Ruth Finley Lein, the founder and publisher of The Fashion Calendar, and of Hank Green. He is survived by his brothers, Jim Green of Brewer, Maine, and Larry Lein of Cresskill, New Jersey. There will be a memorial service in September, the time and date to be announced. I just heard about Joe's passing. I met Joe early in our legal careers, and we played tennis together frequently in the late 70s. We also crossed paths from time to time in our law practices and at Newton Commonwealth Golf Course. Joe was a friend, and I respected him deeply as both a lawyer and as a person. Rich, Matt, Mike, Sarah, Elizabeth and our entire family send out love and our memories of Joe as a wonderful law school colleague, fellow member of the bar, friend, father of friends and all - around great guy. Joe had a measured personality that radiated both seriousness of purpose and incredible human warmth. Running into Joe or taking his call was always a delight. Mike Johnston was a grateful lunch or dinner beneficiary on some of Joe´s visits with Nick in New York, where Joe made him feel so welcome and the conversations covered many eclectic topics. The Green family is fortunate to have had such a wonderful person at its center. Joe truly will be missed by all who have had the privilege and pleasure to know him. Dearest Carol, Jeff, Ariana, and Nick,

I am sad beyond measure to learn of the loss of your good husband and father and my dear friend. I think that Joe was as good, kind, and modest a man as I have ever known.

It seems hard to imagine that it has been more than 44 years since we first met while both teaching in the Clinical Program at Harvard Law School. Joe was on the criminal side and I was on the civil. We were much the same age, both lived in Cambridge, and had friends in common, so it was hardly surprising that we soon became close friends.

At some point, I must have told Joe that I needed more trial experience because he arranged for me to volunteer in the Salem District Court. Not long after that, Joe had me hired by the Essex County District Attorney's Office and then asked me if I'd like to help him write a brief for the Supreme Judicial Court in the "Howie Tuna case."

It was great fun, as even the name of the case suggests. We worked long and well together, as is attested by a twenty-page opinion in our favor which I located just now on the internet at https://law.justia.com/cases/massachusetts/supreme-court/volumes/391/391mass279.html, "Joseph B. Green, Assistant District Attorney (Charles M. Wyzanski, Assistant District Attorney, with him) for the Commonwealth."

Joe and I spent countless hours together along the way, much of it memorably commuting from Cambridge to Salem in a car confiscated from some hapless drug dealer, a pair of oversized and filthy dice still dangling from the rearview mirror.
And before not too long, Nilgun was introduced to, and fell in love with, Carol. I can still see the two of them animatedly talking as Carol pushes Ariana in a stroller around the Salem shopping mall.

Our lives, of course, became ever more closely intertwined in all the years since, what with Shady Hill, family occasions, dinner parties, trips to the North Shore, and with us as shameless long-term guests of the Greens in Lenox and Florida.

There has long rested on our refrigerator door a picture of the four of us devouring lobsters on a picnic bench at The Lobster Pool in Cape Ann overlooking Ipswich Bay. Of course, the four of us did a lot more than just eat and dine together. I remember, for instance, that for a time I tried to match Joe on the tennis court but then found I couldn't. Then there was a time when Joe tried to match Nilgun on the Arthur Murray Dance floor and couldn't. And there's so much more to remember!

Not surprisingly, Joe and I shared some tough times together as well. I was diagnosed with prostate cancer and then many years later he was. Then, of course, there have been the last few months. What I found so remarkable about Joe was that he never, ever felt sorry for himself. He always faced his condition with remarkable courage and equanimity. Even when things looked particularly bleak, he would not let you fret but would assure you that he felt "just fine" when he clearly had to know better.

Even in his last days, Joe manifested a calm, almost beatific expression. He seemed to appreciate how much we all greatly loved and respected him and that seemed to suffice.

In short, Nilgun and I and so many others have been blessed to know Joe and we will always treasure his memory. You, as family, have, of course, so much more to remember him by and to make you so very proud!

Joe impacted my life greatly. He was incredibly funny and beyond compassionate. He was an incredible man.. Thank you for lighting my fire to change the world Joe! I am so deeply sorry for the loss to his family but also to the world. His light was so incredibly bright.
