Elwaine Pomeroy Obituary

Elwaine F. Pomeroy, 78, of Topeka, passed away Wednesday, June 29, 2011 surrounded by his loved ones. He was born June 4, 1933 in Topeka, the son of Charles F. and Ada (Owen) Pomeroy. He graduated from Topeka High School in 1951, Washburn University in 1955, and Magna Cum Laude from Washburn School of Law in 1957. Elwaine was the senior partner in the law firm of Pomeroy and Pomeroy in Topeka, admitted to practice in front of the United States Supreme Court, and owner of Topeka Escrow Service. Senator Pomeroy served for 16 sessions in the Kansas State Senate, with four years as chair of the Local Government Committee and eight years chairing the Senate Judiciary Committee. His dedication to public service led him to read every word in every bill, and he was recognized as Proofreader of the Senate by his colleagues. He was first appointed to the National Uniform Law Commission in 1979 and continuously appointed by both Republican and Democrat governors until 2007 when he was awarded lifetime status. In 1984, he was appointed as chair of the Kansas Parole Board, serving until 1990, at which time he returned to his full time private practice. He continued practicing many fields of law until his death, including being a lobbyist for various groups, such as the American Motion Picture Association. He was a member of Trinity Lutheran Church, where he was a current member of the church council and held various positions of leadership over the years. He was a member of the Topeka Bar Association, Kansas Bar Association, American Bar Association, Topeka Knife and Fork Club, Masonic Lodge, Scottish Rite, Arab Shrine, Order of the Eastern Star, Shawnee Community Mental Health Corporation, Association of Paroling Authorities International, American Correctional Association, Kansas Correctional Association, Kansas Council on Crime and Delinquency, Breakfast Optimist Club, Topeka Civitan Club, and Shawnee County Republican Central Committee. Elwaine married his high school sweetheart, Joanne C. Bunge on September 30, 1950. They spent an inseparable loving marriage of over 59 years before she preceded him in death on February 26, 2010. Survivors include sons, Duane (Deborah) Pomeroy, Topeka, Carl (Deborah) Pomeroy, Tulsa, OK; seven grandchildren, Shane (Janalyn) Pomeroy, Walter (Rebecca) Evans, Troy Pomeroy, Brandon Pomeroy, Matthew (Ashley) Pomeroy, Tyler Pomeroy, and Tessa Pomeroy; three great-grandchildren; three step-great-grandchildren; and a brother, Charles (Lurene) Pomeroy, Topeka. Elwaine was preceded in death by his parents, a daughter, Janella Evans, and a grandson, Alex Evans; siblings, Emerson Pomeroy, Frances Ada Pomeroy, and Mary Pomeroy McNish. During WW II, he was too young to serve in the military with his two older brothers, but contributed to the war effort by selling War Bonds and earned the Top War Bond Salesman Award from the Boy Scouts of America. Memorial services will be 10:30 a.m., Saturday, July 2, 2011 at Trinity Lutheran Church, 731 SW Buchanan, Topeka, KS 66606. Private family inurnment will be at Mount Hope Cemetery, Topeka. Elwaine will lie in state at Penwell-Gabel Mid-Town Chapel, 1321 SW 10th Ave., Topeka where the family will receive friends from 3:00 to 7:00 p.m., Friday. I did not know of your Dads passing. I worked for him & Emerson for years at the Topeka Escrow Service. My fond memory of both of them is around the copy machine {when they would come out of their offices to make copies} and tell some funny story of recent and that robust laugh of your Dad's. Again, I'm sorry I would have liked to have joined the family at visition. I only learned of his passing when my daughter called me and told me of Charles McNish's passing this week.{He did their taxes.} Sorry for your loss.

Elwaine was a friend, teacher and confidant, and we miss him. At different times, but under similar circumstances, we looked his way for affirmation when we would cast a vote at odds with the majority party. Yes, it was his party, but it was never as important to him as voting for the greater good -- in honor of the trust given to him by the people who elected him over and over. We did not always agree, but if we ever doubted that we were doing the right thing, we looked to Elwaine. And, if we asked him, he would always have a sound, logical reason. Thank you, Elwaine, for being our good and lasting friend.

Elwayne's family.:

My friendship with Elwayne goes back to the early days of his law practic and extends through our mutual service in the State Senate and in the Uniform Law Conference. He and I both served as Chairman of the Senate Judiciary Committee and as members of numerous drafting committees in the Conference of Uniform State Laws. He was a man of impeccable integrity and great diligence. My wife and I shared a lot of special occasions with Elwayne and Joanne at numerous functions of the Uniform Law Conference and State and National Bar Association meetings. Just two weeks ago, we had a good visit with Elwayne at a reception at the Kansas Bar Convention in Topeka. Both of us will miss him and the inspiratioon he brought to every occasion

Duane, Carl and family members, You were blessed with the best parents children could ever desire! I met Elwaine when we served together on the Kansas Parole Board. I was a rookie and he was the wise, seasoned mentor. He taught me so much about the law, government and treating people with respect, even when it came to the worst offenders. He was such a kind man with principles that are rarely seen today. One of my fondest memories, in addition to Elwaine and Joanne traveling to Virginia to our wedding, will be enjoying Niagara Falls with them. We all got soaked and had a great time! I am glad they are now together. I thank God for giving me the opportunity to know Elwaine and Joanne Pomeroy. My life was richly blessed from knowing them. My prayers are with all of you through this timme of great loss. Your parents' love and fond memories with carry you through.

Duane, Carl, and family-

We are so sorry for the loss of your wonderful Dad! He was a true gentleman with a heart of gold! Like our own parents, he and your mom were a truly devoted couple. They all set a good example for all of us as we began our lives as newly married couples. Now, they are a couple again. It's so sad to see this "golden" generation slowly leaving our presence, one by one.

I truly cherish the memories of being at your folks' house when Janella and I ran around together! I will never forget the time you two saved the two of us with your tennis rackets, etc! LOL! Not having any brothers of my own, I thought it was really "cool" that you'd come running to "save" us!

I had a lot of fun helping to campaign for your dad too! He was the first "real Senator" I ever met!

Your wonderful memories of your folks will help to ease the pain and enable you to eventually come to peace with your loss. We know you will miss both of them immensely, as will those of us who loved and repected them as friends.

Please know you're all in our thoughts and prayers! We missed the visitation - had it in our minds that it was 5:30-8:30 tonight- we are so sorry! We arrived at 7:45 and were a bit suprised to find the doors locked and the parking lot empty!

Duane, I so respected your Dad and his brother, Emerson. They were part of that group of gentleman attorneys that are passing too quickly out of our lives. Once I had to testify before the Senate, my first time. A senator began to question me harshly. You dad gently drew the questioning away, making it a much kinder experience. (Just as you made it a good experience for Matthew, my 8 year old son, testifying before the city council the first night you served.)

So sorry to hear about Elwaine. I also learned that his wonderful wife passed in 2010. I have not had contact with them for many, many years. Elwaine and I were raised in the same church and graduated from high school the same year, however, I attended Seaman. Elwaine led a beautiful, productive life with his family and those of us fortunate enough to have known him. My wife and I have been friends with Elwaine and his wife Joanne since college days at Washburn University. During my tour in Vietnam, my family lived next door to Elwaine and Joanne and had close and lasting friendships with them and their children, Janella, Carl and Duane. Elwaine and Joanne are together again and our hearts are with them and Duane, Carl and family. With all our love in celebrating Elwaine's life, Dave, Peggy, Paul, David, Jr., Janna, and Mark Broxterman.

Elwaine was the Chairman of the Parole Board when I was appointed in 1984. As the youngest member, I looked to him for guidance and support which he gave unconditionally.
