Joe Eaton Obituary

EATON, THE HONORABLE JOE O., 88. Bee Paw, Poppy, Big Joe, as he was known to his grandchildren, passed away peacefully at his home on September 28, 2008. Joe was born on April 2, 1920 in Monticello, Florida to Robert and Mamie Eaton, the youngest of their five children. He served in WWII as a Major in the 9th Air Force and flew the Martin Marauder B-26 on 51 missions in the European Theatre. He had a long life of public service as a State Senator, Circuit Court Judge and for the last 41 years of his life as a United States District Court Judge. He is survived by his devoted wife Patricia MacVicar Eaton, and for 66 years they shared a marriage that produced three surviving children Joel (Mary), Julie and Janet (Brian Sherr). He was blessed with six grandchildren Alexa Hartley (Charles), Doug Eaton (Molly), Darryl Eaton (Isa), David Eaton, Elise Sherr and Mallerie Sherr. He adored his five great-grandchildren Samuel Eaton, Delia Hartley, Jack Eaton, Otis Eaton and Everett Hartley. A Memorial Service will be held at 2:00 p.m. on Friday, October 3rd at the United Methodist Church of South Miami, 6565 Red Road, Miami, Florida 33143, followed by a private interment. The family will receive guests at 6:30 p.m. on Friday at the home of Joel and Mary Eaton, 9881 S.W. 103rd Street, Miami, Florida 33176. In lieu of flowers, suggested charities in Joe's honor are: Plan USA (Childreach), 155 Palm Way, Warwick, RI 02886 or the United Methodist Church of South Miami, 6565 Red Road, Miami, FL33143. At 6 years of age, I was privileged to have this wonderful man as my Sunday School teacher at South Miami Methodist Church. He influenced my life in a most positive way and made the word of God live in my life even today. He taught lessons I experienced later in life. When you can hardly put one foot in front of the other, God will never put a burden on you that you can not get through. I learned from the relationship and interactions with his beautiful wife who prepared the lessons for him to teach, that marriage is about giving 100 percent from both. What a handsome loving couple in those early days so long ago circa late 40's, early 50's. He might have been in law school at the time as so many WW2 vets were, like almost every dad in our neighborhood.

Dear Pat,
I just heard of Joe's passing. I'm so sorry, and send condolences on behalf of all Joe's WWII friends in the 559th Squadron, as well as myself. I never met Joe, but received a very kind letter from him with a copy of his book "Tiger Stripe." He was held in high regard by all, and I know he will be greatly missed.

My condolences to the Eaton family during this period of grief for a great man. In the late 40s, Joe and I played semi-pro baseball in Miami. Joe played 1st base for EAL and I played in the outfield for Luby Chevy. We were both recalled to active duty with the 435th TCW(USAF) in 1951. Big Joe was one of the coaches on the base football team, of which I was a member. I last visited with the Judge and Pat about 2 years ago. Big Joe, we're going to miss you.

My father told me that Judge Eaton taught him more than anyone else in any educational system has ever taught him. My father continues to pass along all of those values to me. These values that were ultimately brought about by Judge Eaton will stay with my father and I for our entire lives. Even though I never had the chance to personally meet Judge Eaton, I feel that through my father, I have known him for years. My fathers amazing personality and positive attitude are just some of the things I know he learned from Judge Eaton. Thank you for that.

Judge Eaton was an incredible judge. He exercised his judicial power carefully, never forgetting that his might well be the final word in any dispute. He owed his allegiance to the law in general and the Constitution of the United States in particular and not to any party, group or ideology. Judge Eaton epitomized "the cold neutrality of an impartial judge" from the bench, while being a very human and warm person off it.

My deepest condolences to the entire family. He will be missed by everyone who knew him. We met at the 435th TC Wing. I worked on his first Senate campaign. Tony cut our hair at the RedBird Shopping Center. I appeared before me countless times in both the State and Federal Court. He was the must just, fair jurist that one could ask for, even when he ruled against my clients.
He has left behind a wonderful family and a wonderful legacy.

Judge Eaton was one of the finest Judges that I ever had the privilege of trying cases before. Always fair and honest and wise with a sense of humor. I can still remember him saying when I was late for court and pulling into a gas station to tell him I was stuck "Ok Louie you can tell them to stop banging on the car now." He was one of the finest men and my condolences and deepest, heartfelt sympathy to his family, friends and everyone that had the good fortune of knowing him.

With the passing of Judge Joe Eaton, South Florida is without a distinctive pillar and lion of our legal community. Judge Eaton represented the very best our profession could offer. He brought to bear his roots and the lessons gleaned from his upbringing in Monticello upon many difficult and complex legal problems throughout his legendary judicial career. Those of us who were most fortunate to have clerked for Judge Eaton were among the select few who received daily legal and life lessons which were not available in any law school from a giant who was most among the most humble and brilliant constitutional minds any of us will ever know. It was both an honor and privilege to have known Judge Eaton.
