Family-Placed Obituary

JUDGE JAMES C. PAINE 85 years old, of Palm Beach, FL, died Sunday, March 7, 2010 after an extended illness. Born in Valdosta, GA on May 20, 1924, he was the son of Leon A. and Josie Jones Paine. His family moved to West Palm Beach when he was a young boy and he graduated from Palm Beach High School in 1941. He served his country in the U.S. Navy during WWII after which he completed his college studies at Columbia University and then received his Law Degree from the University of Virginia. Upon receiving his law degree he returned to West Palm Beach where he was a founding member of the law firm, Jones, Adams, Paine and Foster. He practiced law for over 25 years before being appointed to serve as a Federal Judge by President Jimmy Carter in 1979. He retired from his judicial duties in 2007. He is survived by his wife of 60 years, Ruth Paine of Palm Beach; three children, James Paine, Jr. of Lake Worth, Jonathan Paine of West Palm Beach and JoEllen Paine of Lake Worth and four grandchildren, James Paine,, Bailey Paine, NicÛlee Paine and Josie Paine. Memorial Services will be held at 3:00 PM on Thursday, March 11, 2010 at the Holy Trinity Episcopal Church, West Palm Beach, with the Rev. David Wilt, Rector, officiating. In lieu of flowers, contributions may be made in his memory to either Holy Trinity Episcopal Church, 211 Trinity Place, West Palm Beach, FL, 33401 or the Children's Home Society, 3333 Forest Hill Blvd., West Palm Beach, FL 33406. Judge Paine was a remarkable man who had a very distinguished career and such a profound impact on the many lives of people he encountered, including mine. He was the first federal judge I ever worked for and he took a genuine interest in everyone he worked with and every defendant who appeared before him. I am so sorry that I could not attend the Judge's funeral and pay my respects in person but I was out of the state until yesterday to welcome home my son Shane, who just returned from a tour in Iraq with the US Army. Although I know it was his time to let go of the physical and finally be free, I just loved having him here. I worked for Judge Paine as an interim law clerk for about 8 months. During that time my own dad passed on, and Judge Paine became, in my heart, a surrogate father of sorts. He is the kind of man I image everyone would want as a father. Gentle, sweet, kind, a compassionate listener, and so sagacious. He was gracefully generous in all ways. Humble, hard working, a commited jurist, appreciative of his staff, wonderful Christmas lunches at the yacht club, and did I mention handsome and charming beyond belief! Heaven is blessed as is his family and this country. Thank you Judge Paine.

Judge Paine was the one, often the only, unwavering force to turn to during my time at the fast paced District Court Clerk's Office. No matter the issue, I knew he would patiently listen and offer fair advice.

15 years later, I still revisit fond memories of knocking on his chamber door, on Halloween, dressed as "The New Judge," or the cleaning lady or the sailor boy. I clearly recall the twinkle in his eyes and sweet smile on his lips. I think he enjoyed those moments as much as I did.

This fine gentleman will be sorely missed.

I had the great honor as a lawyer of participating in one of Judge Paine's first trials as a federal judge. Our adversaries were "Buffalo Bob" Montgomery and his brand new associate, Jack Scarola, in Jack's first civil trial. For four long weeks Judge Paine showed nothing but courtesy, attention, fairness and respect. He ruled the courtroom like he had been there forever, even though he was a novice federal judge. He was the epitome of a gentlemen and will be greatly missed by the legal profession. My condolences to all of his loved ones.
