David Martin Obituary

David Louis MARTIN David Louis Martin - beloved father, husband, friend, and prominent Seattle trial lawyer - passed away peacefully at home on Wednesday, January 11th, 2012 after an 11-month battle with kidney cancer. He was 69. David was born May 13, 1942 in Ogallala, Nebraska, the youngest of three children born to Theodore and Mary Jane Martin. When he was five years old, the Martins moved to Quincy, in Grant County, Washington, where his father ran a dairy farm. On the dairy farm, Dave learned the meaning of unrelenting and hard work; an ethic he perfected over his long career. In 1960 he graduated from Quincy High School, where he was a star athlete and valedictorian of his senior class. Dave graduated from Washington State University 1964. That fall, he began Law School at the University of Washington. He passed the bar in 1967 and worked briefly at the Washington State Attorney General's Office before being drafted into the United States Army in 1968. While posted to Ft. Myer, Virginia as a member of the U.S. Army Military Police, Dave attended George Washington University Law School and obtained a master's degree in labor law. He also met his future wife, Janet Kudela. In late 1970, after marrying Janet, Dave returned to the Seattle area to settle down. After a brief stint as a partner in a personal-injury plaintiff's firm, Dave decided that his destiny lay elsewhere and he joined the firm of Lee Smart in 1972. Over the next few years, Dave's drive, vision, and accomplishments in the courtroom pushed Lee Smart to the forefront of the insurance-defense practice in the Pacific Northwest. Dave remained the driving force and defining personality of the firm for the rest of his life. During his tenure at Lee Smart he tried more than 100 cases to verdict against the best lawyers in the Northwest. Dave was listed in America's Best Lawyers from its first edition to the present. Early in his career, Martindale-Hubbell Law Directory awarded him its highest "AV" rating. Dave has been listed as a Superlawyer since the inception of that ranking in Washington State. In the free time he allowed himself, he enjoyed time atthe family cabin on Camano Island, as well as breeding, training and racing thoroughbreds in Washington, Oregon and California. He was always up for a game of blackjack. Dave was deeply loved and respected by family, friends, his partners, associates and colleagues (despite his sometimes irascible personality) because of his integrity and humanity. He was preceded in death by his parents Theodore and Mary Jane, his brother Theodore and his first wife Janet. He leaves behind his two children Andrew and Jennifer, sister Genevieve, second wife Leigh Ann and many extended family, work family, and friends who will miss his guidance, his stories and his propensity to suddenly break out into song. A funeral Mass will be held at St. Luke Catholic Church, 322 North 175th Street, Shoreline, WA on Thursday, January 19th at 11 a.m. Reception to follow. I met Dave in 1978 during a case he was defending and I was the plaintiff's attorney. I continued to see Dave over the years whether through legal cases or at the race track as we both owned race horses and loved the sport. Our wives both were stricken with breast cancer and we confided in each other during the saddest time in our lives. I enjoyed Dave for the great man he was in all aspects of his life. Just before I was to testify on a case with Dave Martin he sat in the hallway with me and asked me about Quincy. I talked about myself, thinking it was his way of calming my trepidation prior to my first trial with him. Shortly thereafter I learned he, too, was from Quincy -- and then the stories & memories flowed! For me the real Dave emerged and I was able to see his ability to cultivate relationships where he prospered with those around him. It was an honor and a priviledge to know him for the short years I was able to work on his cases. As they say: Go Jackrabbits!!!

I worked with Dave, aka DLM, for over 33 years as his legal assistant, and even though there were turbulent times, I thought the world of him. My boyfriend Jan, aka Jan Stenerud, was also fortunate to get to know him.

When DLM's wife Jan was very ill, she asked him never to name a racehorse after her. He therefore named a horse after me, and treated me and my friends to her races at Emerald Downs. When "Attitrudi" won, DLM insisted we all join him in the winner's circle.

DLM was a good-hearted person, who often showed great kindness and support to others.

Our condolences to Jen, Andy, and Leigh Ann. We miss you, DLM.

Dave Martin was a very special person. Very complex. Focused on excellence. Desirous of bringing out nothing but the best in others. Passionate about justice. Why I was lucky enough to have been mentored by him, I'll never know. But for that, and for his many kindnesses, he is and will always be beloved and remembered. I was so blessed to know him. He was a man of great kindness and passion, and none of us should allow his many great qualities to ever be forgotten. The world now seems emptier, but I am glad he is no longer suffering. Let all who knew his many strengths and great qualities keep them alive in his absence. I wish comfort and strength to all who knew and loved him.

I have known Dave since 1970 when I was a young claim representative at Aetna Casualty. Dave was a young lawyer at the Lee, Smart lawfirm. Dave's wit and sarcasm were something I looked forward to every time we got together. Dave was a great guy. He will be greatly missed. My thoughts and prayers are with all of you.

I met David when I moved to Washington to begin the 8th grade. We went through 8th and high school together, and I never felt anything but friendship and admiration for him--his remarkable mind, his devotion to family, his calm assurance and maturity. I met David years ago and had several cases against him since I am a plaintiff personal injury attorney. David was a tough litigator, but he was trustworthy and compassionate. Our little ritual was whenever he called me, I would ask for a moment so I could rise from my chair and stand at attention (which I did) and it never failed to get a chuckle. I admired David and will miss him.

It has been my privilege and honor to have known and worked with Dave Martin "DLM" for over 30 years as a court reporter. In the early years, all of the reporters that I knew, including myself, were a little afraid to work with him because he was so fierce at his depositions and the outbursts were fast and furious. He was a true gladiator for his clients, a brilliant lawyer, and garnered respect from many. It took a few years to see through the layers of his complex personality, and what I found inside that rough exterior was his sense of humor, his empathy for others, and a true and loyal friend. I will miss him.

I got to know Dave over the past ten years as a lawyer in a neigboring firm. Kind and engaging whenever we met, I anticipated our many pleasant elevator rides and lobby chats, during which he never failed to inquire about my practice, while often sharing some widsom from his own. Clearly revered by those in his firm, his passing will be felt by all of us who knew, liked and respected him. Deepest sympathy to all of Dave's friends and family.

Dave and I first met while I was at Aetna in Seattle as a new supervisor. I got to know the real Dave Martin on a product liability seminar we both attended in Grand Rapids Michigan for the Bliss Punch Press company insured by Aetna. We toured the punch press factory together, noticing several employees missing digits. It was so loud in the factory, I barely could hear Dave telling that we should keep our "hands in our pockets". During the seminar in a hot and humid Holiday Inn basement, Dave dozed off after lunch and his books fell off his schoolhouse type chair, scaring several others of us awake. He denied dozing off, of course, and stated that he was just trying to get the others to pay attention.
Dave and I had many, many cases together over the years, and wherever my career path went, I asked Dave to help my employer save money and win cases, which, of course, he did. I always enjoyed our catch up phone calls when we talked about old times and our trips together. He was the best defense lawyer that I have ever worked with over my similar tenure as Dave. I could count on Dave to know everybody in the business, friend or foe, and for him to simply pick up the phone, call the plaintiff attorney and then call me back with the real skinny on the case. Reading the comments of others who came in contact with Dave, I think everyone does realize what a huge loss this is for the Seattle legal and adjusting community with Dave's passing.
He was simply the best. I will miss you my friend. Thank you for your mentoring and memories. My sympathies to his family in this difficult time.

Jen, Andy, and Leigh Ann - David and I were together in school together in Quincy and WSU, I have many fond memories both from High School and College and especially our spirited discussion during High School catechism classes.. David was one of the "few" Democrats in Whitman County while at WSU, and I had the pleasure of working with Dave turning the Mock Political Convention into a total disaster for the Young Republican's. In our more than 31 years working together, Dave Martin was my boss, law partner, teacher, mentor, and friend. At any given moment he could be funny, angry, mischievous, impossible, inspiring, shrewd, cantankerous, empathic, or brilliant, or a combination of several of those at the same time. What never varied was the excellence and integrity with which he practiced law. More than anyone who ever worked Lee Smart in its 99-year history, he set our course and showed us how the job is done. Many Lee Smart lawyers stayed, and many now work elsewhere, but all who practiced with him are in his debt.
