PAT BRIAN Obituary

Pat B. Brian 1938 ~ 2010 Judge Pat B. Brian died peacefully at his summer home in Grover, UT on June 28, 2010 of pancreatic cancer. His wife and children were at his side at the time of his death. Pat was born March 17, 1938 to Arthur and Wilma Brian. He grew up on a ranch in Loa, Utah and was the fifth of nine children. He married Sherry Hale in the Salt Lake Temple on June 28, 1962. Pat graduated from Brigham Young University in 1962 and then earned his law degree from Vanderbilt University in 1965. Soon afterwards he began his legal career with the District Attorney's Office in Orange County, California. He was a federal prosecutor in Anchorage, Alaska. He was an adjunct professor at Pepperdine Law School and Brigham Young Law School for a combined 24 years. He lectured extensively in Mongolia, China, and Ukraine on the American Rule of Law. He also had the unique privilege of serving as a visiting professor at the prestigious Fudan University Law School in Shanghai, China. Pat was inducted as a lifetime member of the Shanghai Arbitration Commission. Judge Brian served for 23 years as a district court judge in Salt Lake City, Tooele and Summit Counties. He loved the law. Church service was paramount in Pat's life. He served as a bishop, stake president, mission president, regional representative, director of the Kirtland Ohio Historic Sites, and as a temple worker. Pat's lifetime hobby was traveling the world with his wife. His travels through mortality are now over. One door closes and another door opens. Pat is survived by his wife Sherry, his six children and 21 grandchildren. Their children are Darin Brian Nielson (Peter), Derik Brian (April), Kurt Brian (Marnie), Brett Brian (Christy), Kam Brian (Katherine) and Brandi Brian Terry (Jacob). He is also survived by four of his siblings -- Bill, Dick, Linda and Camiel. A closed casket viewing will be held on Thursday evening, July 1st, from 6 - 8 p.m. at the Larkin Sunset Gardens Mortuary on 10600 S. and 1950 E. in Sandy, UT. The funeral will be held on Fri. morning, July 2, at 10 a.m. at the LDS chapel on Mike Weir Dr. (adjacent to the Draper Temple) in Draper, UT, preceded by a viewing from 9 -10 a.m. Visit www.memoriesofpat.blogspot.com for more on Pat's life.

I am so sorry to learn your husband had died. From the obituary, it shows you had a wonderful life with him...but, was there anything less for THE Sherry Hale! We are so sorry to hear that our beloved "Pat" is gone. We heard of his passing while we were in Great Falls, Montana (on our way to Glacier). My Dad, Ken Garrett was very taken by the news, we thought of flying him out to make the funeral, but at 87, it would of been to much for him to do. He told me of the wonderful Father's Day he spent with Pat and Sherry, just a week earlier.....and then he told stories the rest of the trip of his dear friend. Starting out with meeting in California as lawyers, to flying to Wayne County, to Lake Powell trips...and so on. What great memories!!!! Of course, I had some myself, I was a shy child, he was always trying to get me to mingle with everyone. Always was taking me under his wing, calling and checking up on me....I loved that......Pat married my husband and I, and we will always remember Pat in our hearts...the world will miss him, but he is welcomed in Heaven to do more important work...I am sure he is saying Hi to my Mom!!! Dear Sherry, I am so sorry for your loss. When a friend told me Judge Brian had passed on I could hardly believe her. He had so much energy and kindness. He would arrive in Summit County for his turn (or any other judge's turn who choose not to come) to handle our Court. He always had a big smile and entered saying, "Top of the morning." I was the District Court clerk for 23 years and I was always happy when he came on the 6 month judges rotation. He said that you were a 'Trooper' to go with him on his trips. And he loved to make tomato soup for 'Grandma Hale' and sometimes he would hand me a note to call her to say he would be late in court so he couldn't make it that particular night but he would another night. I also remember his generousity with the Hale Theater tickets when they weren't sold out. I will miss him; he was so like a family member to me; not a boss. He was such a caring person. Love to you and your family.

Sherry and family,
Eldon and I were so shocked and saddened when we heard of Pat's passing in the Church News today.

We have such happy memories of our time together on Apple Hill. What a priceless time that was! The outing at your place in Loa with all the neighborhood was such a treasured time.

Eldon and I had such a great time with you traveling to California and attending the production at the Hale Theatre there.

Our whole family loved you and Pat, and of course your beautiful family. You are all very dear to us! We have always looked to you and Pat and admired your genuine kindness and Christlike love and service.

Judge Pat Brian was , by far, one of the most wonderful people! He has been our family friend for many years. 26 years ago,as a newley married couple, we bought our very first refrigerator from him. What we couldnt afford to pay him, at the time, he allowed Scott to work off doing flooring work in his family home. (in fact we still have that fridge in our garage...and it still works!) Many years later, we had the honor of having him officaite at the wedding ceremony of our oldest daughter. Pat always had a smile and a kind word whenever we saw him. We have the most fond memories and utmost respect for this fabulous man, and feel it a true privilege to have had the chance to know him. Our deepest condolences to his family. Heaven has welcomed a true Angel!

Dear Brian Family: I was a young girl out of High School when I started working at the McMurray, McIntosh, Butler & Nielson law office with Pat. I loved his smile and he was always so nice to me. That seems eons ago. I remember the wedding reception you had in your home for his secretary when she got married. You were so very generous to let your home be shared for that special event. To The Brian Family, I happened to be glancing at the obituaries this evening and came across Judge Brian's Obituary. You don't know me but I had the wonderful pleasure of sitting in Judge Brian's chambers on a beautiful winter morning as he finalized the adoption of our precious daughter who is now 14 years old. What a very sweet man Judge Brian was. I will never forget as the court proceedings were done how he threw up his arms in pure joy and he declared this was the best part of being a judge then took time from his busy court schedule and posed for several pictures with our new daughter and family. Judge Brian made that day a memory that will never be forgotten (I had only wished we had gotten him again when we adopted our son). What an honor it was to have had the priviledge of sitting with him for a brief time in his chambers, what a kind man he was. My deepest and heartfelt sympathies are sent to you this day as you mourn the loss of your husband, father, grandfather, friend and judge. May God be with you till you meet again.

I have a lot of fun memories of Judge Brian from him telling defendants when sentencing that if they committed another crime he would send them to prison and then say "can you dig?" We so loved this man. He was our idea of "The Perfect Human Being". He loved hearing our tale of when he offered his vacation home to us (20 years ago) and we could NOT find the key. We decided to climb through an open window for access. After we were there 1/2 hour ... we noticed there were no photos of Pat or Sherry. We asked the day worker outside, and he pointed to the house on the NEXT PROPERTY. We were in the WRONG HOME! Pat loved that story and telling us, "Oh not a problem, that's a relatives home also." YIKES! (If YOU are "the relative" ... our apologies... 20 years late.) Blessings to the entire BRIAN family. We are so sad with this news.

I mostly missed Pat at BYU although his sunset was spectacular and has produced a constant bright glow around him ever since. He and I served in similar spaces through some years and I have admired him. Sherry has been a marvelous partner and has added immensely to his life.
