MAXIMILIAN KEMPNER Obituary

KEMPNER, Maximilian W. Died at home in Lexington, Massachusetts on February 23, 2021, four days shy of his 92nd birthday. Lawyer, law school dean, humanist, lover of chamber music, painting and poetry, he relished life as husband, father, grandfather, great-grandfather and friend. A native Berliner, he fled Nazi Germany with his family in 1938, first to England and then to New York. He was proud of his US citizenship and felt responsible for strengthening the rule of law and the spirit of liberty. He graduated from Milton Academy, Harvard College, where he concentrated in art history, and Harvard Law School. He studied law and economics at Columbia Law School, where he earned an LL.M. His education never ceased, thanks to a series of close mentors, beginning with his father. He served in the US Army in Germany, where he taught at the Intelligence School in Oberammergau. He practiced law in New York as a partner with Webster & Sheffield, concentrating on the representation of universities, foundations and public benefit organizations. He was known throughout the legal community as a man of decency and unwavering integrity. Later in life, he moved to Vermont, where he became the Dean of Vermont Law School. His life companion, partner, adviser, and spiritual guide was his wife of 68 years, Paige Mooney Kempner, who predeceased him in December 2020. Paige was a sculptor, writer and mother of their three children, Paul, Daphne and Emily, who survive him. A Memorial Service will be held at a later date. Lexington 781-862-1800

Max and I shared a love of music. When he learned that I considered Haydn to be "boring," he was horrified. He then plied me with exquisite selections from Haydn's works, which changed my view of Haydn completely. He followed this up with a CD containing Haydn's symphonies 103 and 104. With his deliciously impish sense of humor, he wrote on the accompanying card, "I finally got this right. Papa Haydn"

Max was very likely the wittiest person we ever met, as well as one of the kindest and most modest.

Max loved music deeply and was devoted to both the concerts and the musicians at Marlboro. When Ellen told him that she sometimes found Haydn "boring," he sent her a recording of Haydn´s 102nd symphony with a note saying, ""I finally got it right. Papa Haydn." Other CDs followed.

When you told Max a joke, you never feared that he wouldn't get it. Indeed, he would generally top it with some puckish verbal twist. He never came within a mile of boasting of his many accomplishments, though he was always full of praise for his wife Paige. He was endlessly curious and an excellent listener. He knew a great deal about the world, and if you asked he would tell you what he knew. But he would much rather have had a discussion about you and your interests than about himself.

We miss him. Hardly a week goes by when we don´t think of him.

I always enjoyed talking with Max. Not only was he good at sharing his interesting life but he was also genuinely interested in me as well. A humble man, one of the few law school faculity that wanted to live in our town.

Max and Paige were the cornerstones of my life during my time at Vermont Law School. I was honored to serve as Max’s CFO as he built the school into a model institution.
After his retirement I treasured his visits to his home and visits with Max, Paige , and their family.

Max loved Vermont Law School. I recall fondly dinners he would host capped off with engaging roundtable discussions. He loved a free exchange of diverse views. A life well lived for a kind and brilliant man.
