RICHARD GARGIULO Obituary

Gargiulo, Richard Of Beacon Hill, Boston and Cotuit, MA, beloved husband of Andrea W. Gargiulo, died unexpectedly on October 9 at the age of 76. Mr. Gargiulo was a highly regarded trial attorney who received numerous awards throughout his career. A graduate of the University of Maryland and Suffolk University Law School, he first worked in the Office of the District Attorney for Middlesex County, MA, where he served as First Assistant District Attorney from 1970-1973, responsible for all investigations and trials assigned to more than forty assistant district attorneys. He was designated by the Chief Justice of the Superior Court of Massachusetts to conduct an investigation involving the manipulation of various judicial proceedings which resulted in the impeachment trial of one sitting justice of the Superior Court and the sanction of another. He was also responsible for the prosecution and conviction of the chairman of the Committee on Counties of the Massachusetts legislature. Mr. Gargiulo entered private practice in 1973, and in 1986 formed a law firm, Gargiulo/Rudnick, LLP of Boston and Mashpee, MA, with his brother Edward R. Gargiulo and others. His practice included the trial and appeal of complex civil and criminal litigation representing clients in state and federal courts throughout the country. He spent a number of years as counsel to a major Japanese automobile manufacturer, and also represented an international pharmaceutical company and domestic drug testing laboratories among many other corporate and individual clients. In recognition of his consistent professional excellence, he was elected to membership in the prestigious American College of Trial Lawyers. Mr. Gargiulo was most proud of a pro bono case early in his career in which he won the exoneration of a mentally deficient young black man who was serving a sentence based upon a coerced and false confession. He was always happy to take time to help others, and was beloved by many attorneys, young and old, as a mentor and friend. An avid and accomplished sailor, Mr. Gargiulo raced his Frers and Cibils 44 ketch, Polaris, to Bermuda three times and, with three others, he sailed for 22 days from Cape Cod to Portugal. He kept Polaris in Europe for over a year, and with his wife, children and friends joining him at various ports, he sailed the coasts of Portugal, Gibraltar, Spain, Mallorca, Menorca, and Ibiza. Mr. Gargiulo's greatest love was spending time with his family. In addition to his adored wife, Andrea, he leaves his children Richard A. Gargiulo, Jr. and spouse Olive Byrnes Gargiulo of Boston, MA; Andrea Gargiulo Mitchell and spouse Daniel of Rancho Cucamonga, CA; Christopher J. Gargiulo and spouse Kristi Munro Gargiulo of Cotuit, MA; and John Gargiulo and spouse Sidney Hawkins Gargiulo of Palo Alto, CA, and ten grandchildren: Molly and Megan Mitchell and Lucy, Sofia, Michael, Claudia, Elena, Jake, Julia, and Jack Gargiulo. He is also survived by his brother Edward R. Gargiulo, Jr. and his wife Barbara of Cotuit, as well as many nieces and nephews. He was predeceased by his parents Edward R. Gargiulo, Sr. and Violet Gargiulo and by his sister Gail Gargiulo Robinson. I remember how nice Richard was when I worked in Mashpee as a legal assistant. He would come into the office with his cute dog. He was funny with my boyfriend at the annual Christmas Party - he talked to him as a fellow Italian! Such a talented attorney, but also just a regular guy. I'm glad I had the opportunity of working at his firm.

Dear Andrea, Edward and Richard's family,

I learned the sad news of Richard's passing just today. The world is a poorer place for it indeed.

Over the years, Richard was a good friend to me and helped me several times when it was not fashionable to do so. I will always remain grateful to Richard -- and to Edward --for that. If someone stood facing a personal storm and Richard promised to be at his or her back, one never needed to look around to check -- He inspired that sort of trust.

He was a seafarer, literally and metaphorically, of the highest order and I will miss him dearly.
