The lawyers and staff of Proskauer Rose LLP mourn the untimely passing of our beloved partner, colleague and friend Hank Goldsmith. Hank waged a valiant battle against his illness over the past year, displaying the unyielding optimism he brought to life every day and the toughness that made him such a formidable legal talent. Throughout his struggle, Hank made clear to all of us how deeply he loved his family. Nothing meant more to him than his sons Eric, Jake and Ryan Goldsmith. Indeed, no conversation with Hank was complete until the latest event involving each boy was discussed in depth. He adored his wife Debbie and embraced his stepsons Avery and Ethan Kriss with his characteristic warmth because no disease could ever diminish his immeasurable heart. Hank received a B.A., cum laude, from the State University of New York at Binghamton and earned his J.D., cum laude, from Georgetown University Law Center in 1987. He spent nearly his entire legal career at Proskauer and became a Partner in 1997. A brilliant trial and appellate lawyer, Hank represented clients in the financial services, real estate and entertainment industries. In two of his most significant cases, he represented the recording industry trade group in the copyright case against Napster and acted as lead counsel on an important amicus brief for a number of international copyright holders in the U.S. Supreme Court. Hank loved to teach and countless Proskauer litigation associates developed under his tutelage and guidance. The enormous appreciation that Hank’s clients had for his work was perhaps best expressed by the number who surrounded his bedside over these past few weeks. Hank loved the practice of law, the firm and his clients and the feeling was mutual. He had a unique wit that he used as a lawyer to persuade and as a friend and colleague to entertain. No one was quicker with a quip to illustrate a point. And in the tradition of great lawyers who were artists in their off hours, Hank was a skilled guitarist, bass player and singer who performed in several tribute bands most recently The Newspaper Taxis (Beatles), the Carjackers (the Cars) and the Petty Thieves (Tom Petty). Proskauer extends its deepest sympathies to his wife Debbie, sons Eric, Jake and Ryan Goldsmith and stepsons Avery and Ethan Kriss. Hank and Debbie showed us all the power of love and devotion, inspiring hope in the human condition at a time when we might otherwise have only felt grief. This may be a testament to how unexpectedly enduring our encounters with other folks can be over the winding course of our lives. We send out fingerling roots, and they surprise us by remaining intact in our hearts and memories many, many years down the road.

My wife, Susan, just saw Hank's obit in the Georgetown Law magazine. She was in the same class as Hank ('87) and we all lived in the same dorm-- at Trinity College!-- during their first year at law school. I was in grad school at Catholic that year, myself, and Hank lived two doors down from me. I can confirm that even then, he was the remarkable, energetic, talented, driven, brilliant, sometimes-rather-ribald, supremely self-confident, mind-speaking, flat-out hilarious man that you all came to love and to know so much better than we ever had an opportunity to. But. . . my wife and I have both mentioned him fondly over the intervening years, and wondered if he had indeed done well for himself, knowing full well that of COURSE he had. And as sad as it makes us to see that someone we remember only from our youth (someone who generally seemed about 75% more alive than any of the rest of us could ever hope to be) has been far too soon taken away, there's still a bit of warm comfort in the fact that he so obviously continued on his sure path, and touched and benefited so very, very many lives in such a profound way.

So sorry that he's gone, believe me. But still so glad that he was here.

I met Hank when we worked together on a bankruptcy case a couple of years ago. I caught a glimpse of a very talented lawyer and wonderful person. Even based on my limited time with him, every word I have read here rings true.

My heart is truly broken. I kept reading his beautiful wife's facebook page over and over in total disbelief. I also saw them last year so very much in love. May God bless all of you. For My Cousin Hank

I am on the banks,
An observer.
Like a dragonfly
flitting through the reeds,
it seems I have been here forever
and for the single flap
of furious beating wings.
Out there, in the currents,
oars sink deep
and the boats slice forward
elegant, a splash against the bow.
Laughter floats toward me,
wispy seeds of a dried dandelion flower.
There is music here too,
voices like hummingbirds hovering
over a pot filled with honey.
The music curls along my skin,
raises the hair on my arms,
catches me in the throat,
an unnameable, unacknowledged lump.
A breath I forget to take.
I catch glimpses of faces in the
dizzying array of those sailing by me:
smiles, deep furrowed brows, hands clenched
lovingly, dipping fingers into
the river as it rushes to the distance.
I glance down and see my reflection
and it startles me.
My features, rippling the surface,
match some of those who
have sailed by,
without my raising my voice,
without my wading into the water.
I might have waved.
So fast, so silent, my heels
sinking so deep into the muddy banks.
I might have waved.
Dear cousin, I might have waved.
I wade in now, too late, my gaze
lingering on the wake.
I glance back at the banks.
There is no more time to waste
watching.
I enter the water and let the waves
take me
into wonder
and the whirl of life.

Hank loved life, and life loved him right back. I don't know many people who can have a beautiful family, a fulfilling profession and remain devoted to their artistic leanings.....and make it all look easy. His family should know that the way he loved life really does give the rest of us a blueprint for something more than the typical. How lucky each of you are to be blessed with his everlasting love and guidance. I am sure that love is a song that never ends.

I met Hank when we put together the second version of the Petty Thieves at the Jam and I also sat in with the NewsPaper Taxis on occasion. Hank was passionate about playing music. You could tell he loved it - it seemed to bring him to a special place when we played. He was always joking - very witty - it made the music experience even more enjoyable - it was anti-work - just fun and laughs and good music - a great way to unwind after a work day in NYC. For this, I will always remember Hank. I will miss that feeling. Rest in Peace my friend..
