Michael "Mike" Pertschuk passed away peacefully November 16th in Santa Fe, age 89. Mike had a great talent for appreciating and defending both people and political causes. His sweetness and caring delighted family and friends, yet politically he was tenacious, fiercely determined, fighting for consumers and public health and safety. Cigarette manufacturer Phillip Morris once named him their "Number One Enemy".
Mike was born January 12, 1933, in London. With the outbreak of war in Europe, his family moved to New York City when he was four. He earned his B.A. at Yale in 1954; then served two years in the army, before receiving his law degree from Yale in 1959.
After clerking for Hon. Gus J. Solomon, Chief Judge of the U.S. District Court for the District of Oregon, he came to Washington as a Legislative Assistant to Senator Maurine Neuberger (D-OR). He found himself, following the 1964 release of the Surgeon General's Report on Smoking and Health, as the leading Senate staffer handling tobacco control issues. It was in this role that he soon caught the eye of Senator Warren G. Magnuson, Chairman of the Senate Commerce Committee, and joined the committee staff; subsequently becoming Chief Counsel from 1969; and Staff Director and Chief Counsel until his departure from the Committee in 1977.
He was often called, by both his allies and adversaries alike, "the 101st Senator", in recognition of his significant role in so many major legislative accomplishments in the areas of consumer protection, child safety, broadcast advertising and automobile and product safety.
During his time leading the Commerce Committee staff, some of the most significant consumer and environmental protection measures of the 20th century were prepared by the staff under his direction, including the Natural Gas Pipeline Safety Act, Recreational Boat Safety Act, Public Health Cigarette Smoking Act, Federal Railroad Safety Act, Consumer Product Safety Act, Magnuson- Moss Warranty Act, Toxic Substances Control Act (TOSCA), and the Safe Drinking Water Act.
Recognizing Mike's commitment, President Carter named him Chairman of the Federal Trade Commission in 1977, where he continued to serve as an FTC commissioner from 1981 to 1984. Back in private life in 1984, he co-founded, and co-directed for many years, the Advocacy Institute, training social justice advocates in the US and emerging democracies in the skills of advocacy. Mike was a prolific writer and published many magazine articles, four advocacy guides combatting the tobacco industry, and seven books, the last of which, When the Senate Worked for Us: The Invisible Role of Staffers in Countering Corporate Lobbies was published by Vanderbilt University Press in 2017.
In 2003, he and his wife, Anna, left Washington D.C. to settle in Santa Fe. There he discovered opportunities to continue his advocacy training with New Mexico's young leaders. He made new friendships, studied James Joyce, diligently practiced Tai Chi, went dancing on the Plaza, while continuing to write and publish, and always, always tracking the pulse of politics.
To family and friends, he is honored and remembered for his unabashed warmth, finding beauty at the heart of things. He lit a blessed fire of service and love that will live on after him.
He is survived by his wife Anna Sofaer, sons Mark Pertschuk (Karen Pertschuk) and Daniel Sofaer, his daughter Amy Pertschuk (Chris Krueger), and three grandchildren; Jack Pertschuk, and Nick and Mia Krueger. There will be a private memorial service at a later date.

Anna I am learning about Michael´s death from the NYT. we met while staying at that cute little beach front hotel in Tortola. My husband Bob and I shared a sailboat with you. And then we visited once on Morningside drive
I am living in Phoenix. Followed the dtr here and loving life tho not the politics.
I wish you well. Bob died in 2019
I´m sure you´re surrounded by people who will support you through this big life change very good wishes

Dear Mark and family,
I loved Mike. He made me want to make a difference in the world. I am so very sorry for your loss. Mike was more than a great man but a great human being who loved his fellow man enough to advocate for the health of others who were less fortunate than most of us. God bless you all with His peace. Mike is making policy changes in Heaven already, and we will all be better for his efforts there as we have all been here.

I was so sorry to hear of Mike's passing. What a wonderful person and great inspirational leader. We will all miss him.

I worked for Mike at the Federal Trade Commission. When I served as a regional director, Mike spent several days at our office. He thereafter wrote an inspirational article about us which I proudly saved. The article provided long term motivation to a great staff.

While Mike's days on earth have ended, his many outstanding contributions for the betterment of all of us live on.

My condolences to the Pertschuk family. Thanks to Ross Hammond for passing the news on via LinkedIn. His phrasing - noting Mike´s joy, strategy, and persistence - resonates well. Mike´s legacy will be seen in generations of effective leaders in advocacy for positive change, especially around public health, above and beyond the incredibly significant laws and policies that he personally helped to make happen.
I´m grateful for the brief chance I had to work with Mike and without a doubt, it helped shaped me, my career, and how I´ve engaged with or taught about advocacy ever since.

This was exemplified in the pivotal midwifery role he played in birthing India´s tobacco control coalition, Advocacy Forum for Tobacco Control in early 2000. He held deep respect for local cultures and needs, marked by an insistence on local leadership to initiatives.

Dear Anna (and the family), my deep sympathy....
I did remeber Mike many times, and regret we were not in contact during last years. He really influenced me (and thus my colleagues) in resistence to tobacco industry, to find right arguments. I also remember you both as nice and warm people. I hope you had succes with the pueblo research, and we are thankfull to our kacina Tsitoto who saves our house....My thoughts are with you.

Here's an edited letter sent to me on October 10, 1979, during my final year of law school, by then FTC Chairman Michael Pertschuk:

Dear Mr. Frankel:

I would like you to come work with us at the Federal Trade Commission in the Bureau of Competition. I'm delighted to make this offer because the qualities of public interest conmitment and academic and professional excellence that you've demonstrated are the very qualities which will strengthen this agency as the nation's largest and best public interest law firm. I'm confident too that the opportunity to work with us will satisfy both your professional goals and the overriding need for public service.
Make no mistake, the Commission's tasks are rarely easy or routine.

The most significant battles in the consumer interest are always fought uphill and resources available to your legal adversaries will dwarf your own.

There also are frustrations. We are committed to slashing bureaucratic red tape which binds the hands of goverment attorneys, but pockets of bureaucracy persist. Although the physical, setting is by no means as luxurious as many law offices, we promise you the work will satisfy the soul and that you will have strong and unyielding support in pursuit of justice and equity.

Your initial appointment will be as a Law Clerk, GS-11, at $20,611 per annum. As soon as you have been admitted to the Bar (within fourteen months) you will be designated an "attorney" (a loftier title but alas at the same grade and salary). We also assume, of course, that you are inexorably headed toward the successful completion of your law school studies.

My condolences to Mike´s family. I met him a number of times when I worked at the Campaign for Tobacco-Free Kids. There was a palpable shift in the energy of the office when he came in the door, always with a big smile, always greeting everyone. His expertise was sought after and he was always willing to take a moment to listen. May his life and memory be a blessing to all.

I began a career of public service with Mike as my first boss, exemplar and inspiration. He was always a happy warrior for justice and a champion for individuals and families in the face of forces - often corporate- that would threaten their health and well-being.

Whimsical and wise, with an incisively bright mind and generous heart, he was always truly a pleasure to be with, and his upbeat passion to make things better was ever-infectious.

For my whole life, Cousin Mike was held up as the epitome of a good Democrat - someone who believed in the power of government and laws to help people and create a better society. He always kept an essential faith in humanity and distrust of corporations.
But on a personal level, for my family, Mike & his family were always a refuge and the epitome of kinship & hospitality. His father sent my grandfather the boat ticket and sponsorship for entrance to the U.S. that saved my grandpa from the Nazis and was responsible for my existence. When my mom ran away from home after the first year of college, she went to Michael, and he took her in for as long as she needed. Michael and Anna opened their doors for a summer to me and Adam and shared their wisdom and hospitality with us on many subjects. For the whole of my childhood, my mother reminded me that if a Pertschuk ever showed up on my doorstep in need - of anything - we would gratefully help however we could - but he never asked. Cousin Mike was a patriarch and a mensch and a tzadik in so many ways. His door was always open, and his memory will be for many blessings.
