CHARLES MORGAN Obituary

Charles O. Morgan, Jr. August 13, 1921 - May 28, 2012 Charles O. Morgan, Jr., a preeminent San Francisco attorney, passed away peacefully on Memorial Day, May 28, 2012, with his wife, Lydia, by his side. He was 90. Mr. Morgan was born in Los Angeles to Charles and Dorothy Morgan. The family, including his younger brother Hank, moved to San Francisco in 1922. Mr. Morgan graduated from Lowell High School in 1938, where he played quarterback for the varsity football team and was known as "Touchdown" Morgan. He continued playing football at the University of California at Los Angeles, and was on a team that included future baseball pioneer Jackie Robinson. Following the outbreak of World War II, Mr. Morgan enlisted in the armed services in 1943 and served with the 485th Bomb Group of the Army Air Force, eventually earning the rank of captain. As a navigator, Mr. Morgan flew 63 missions in the European Theatre and was awarded the Distinguished Flying Cross, the Air Medal [with 3 Oak Leaf Clusters], and a Presidential Unit Citation. The Distinguished Flying Cross was awarded when the B-24 Mr. Morgan was on returned to its home field successfully despite receiving 220 flak holes, earning him a new nickname, "Flak." After his discharge, Mr. Morgan returned to San Francisco to study law at Hastings College of the Law, graduating in 1949. Mr. Morgan opened his first office in 1950 and went on to have a remarkable career in the law. A formidable opponent for more than fifty years, he had a keen intellect and was widely considered to be among the elite trial attorneys. He was a consummate gentleman, in and out of the courtroom, renowned for his ability to eviscerate a witness on cross-examination without ever raising his voice. Mr. Morgan tried a wide variety of cases, including celebrity divorces, criminal defense, and all types of civil litigation, with a special expertise in the defamation area. He also argued a number of cases in the courts of appeal, and the United States Supreme Court established an important precedent in defamation law following his argument in the landmark case of Masson v. New Yorker Magazine, Inc. Throughout Mr. Morgan's career, many young attorneys came to work for and learn from him. For many of those young lawyers, Mr. Morgan was a hero and a mentor, someone who could be relied on for advice and guidance. In 1973 Mr. Morgan met Lydia and they later married. They were devoted to each other and loved spending time together, including extensive travel to Europe, trips to Silverado and weekly walks in Golden Gate Park. Mr. Morgan was preceded in death by his parents and his brother Hank. Mr. Morgan is survived by Lydia and will be greatly missed by Lydia, friends, family and colleagues. All will remember Mr. Morgan for his love of the law, his intelligence, his kind generous spirit, and unfailing loyalty to the people in his life. A memorial service celebrating his life will be held at 3 pm on June 29, 2012, at the Presidio Chapel, 130 Fisher Loop, Presidio, San Francisco. Donations in his memory may be made to Paralyzed Veteran's of America, 3801 Miranda Avenue, Palo Alto, CA, 94304.

Mr. Morgan aka Charles, I just want to let you know that you made a great difference in my life. You hired me as your legal secretary at $10 an hour and I was grateful. I was a pregnant married Black woman who was pregnant who took a chance on me and I ended up becoming your legal secretary. Just to let you know Mr. Morgan my son became an EMT, Fire Fighter, Police Officer, and now someone who owns his private security firm. I've had kids since from my husband of 18 years who are now Veteranarian, my daughter becoming a psychiatrist for children, and my youngest to be a journeyman electrician. Thank you Mr. Morgan because you started a life long legacy of successful people in the Black community by just hiring their mother for $10 an hour. Thank you love and miss you and please believe me that I am paying it forward. Mr. Morgan I am currently pursuing my Masters Degree as a Nurse and I constantly talk and write about you as far as you being the lawyer/man that helped create HIPPA.

I just found out you passed away almost a year ago! I am sorry to hear of your passing! You were married to my Aunt Nancy and I remember you fondly the few times you visited my Grandmother Newton in Cedar Vale, KS. I have a great picture of you together. God's blessings a comfort to Lydia.

Your service to our country was appreciated and amazing! I didn't know any of that information!

Mr. Morgan, you gave me my first legal secretary job in 1986, an inexperienced assistant whom you allowed to learn as I went. I had the pleasure of working with you while at the time you represented Willie Brown while he was Speaker of the House, on the Jeffrey Masson v New Yorker Magazine defamation case, and your representation of Danielle Steele's husband, to name a few. Although I moved on to larger law firms, through the years I never forgot your kindness and professionalism. I am a better person for having known and worked with you. You will not be forgotten. Thank you.

Dear Charles, I know you have heard this from me before and it wasn't just flattery, you are a gentleman with integrity and honor that radiates in and out of the courtroom. I remember how you forged on to save anymore grandma's and grandpa's from losing their life savings even though you didn't get paid for all your valuable time. You were amazing to watch in a courtroom. Remember the defendant who commented rather rudely, "I'll never walk in Morgan's courtroom again." You laughed and we laughed at that for months. Intelligence, brilliance and goodness for man radiated when you are there. Respect is monumental and so is the loss. I am missing you dearly. There is much to say. We need men like you and life is too short, but you certainly made your mark. I told my family years ago that you, Charles Morgan, are an outstanding role model for them to follow.

Dearest Charley, you were truly a special person. I cherish the time I spent with you, both professionally where you taught me so much and personally where we shared such wonderful memories and stories about your remarkable life and our family. You touched my life, as well as many others, in very special ways, more than you will ever know or words can express. While I was overwhelmed with grief upon your passing, I am so grateful that I had the opportunity to see you the day prior and tell you how much I love and admire you. I am comforted knowing that you are now with Hank, your Mom and Dad, Uncle Henry and Nancy, Granny and other family and friends in heaven and will forever be surrounded with peace, love and all that is beautiful.

I am truly sorry to hear of the passing of Charles. I had known him since 1994, and his obituary only gives a small summary of what a great man, lawyer and true gentleman he was. I will never forget him as I owed him a great debt of gratitude for his services, friendship and guidance. We shared many a story of our lives, even though we were from different generations. We were both life long San Franciscans, ex-military and graduates from Hastings. I always admired his integrity, sharp mind and wit. His passing is truly a loss to our community.
