Daniel Bushnell Obituary

Daniel Stott Bushnell 1923 ~ 2002 Daniel Stott Bushnell, 79, died suddenly December 23, 2002. He was born in Meadow, Millard County, Utah, November 15, 1923 to Daniel Dearden Bushnell and Melba Ellen Stott. The family lived a short time in Cedar City, then moved to Salt Lake City about 1940. Dan attended West High School where he was a Student Body officer and won the State debate championship. He attended University of Utah and BYU briefly before World War II. On March 15, 1943 he married Audry Huffaker in the Salt Lake Temple. They were the parents of three children: Shonnie, Steven, and Susan. During World War II he was a pilot-instructor in the US Air Corps, flying PBY seaplanes used in Air-Sea Rescues. In January 1946 he entered Stanford University where he received his BA and JD (Law) degrees. He was affiliated at first with Richards and Bird Law Firm, later with Bushnell and Beesley, and finally with Kirton, McConkie and Bushnell. He had a long and distinguished career as a litigator, representing hospitals, school districts, and the LDS Church. He served one term in the Utah House of Representatives, 1951. Audry died on November 12, 1962. He married Miriam Christensen Nelson, December 5, 1963. They were later sealed in the Salt Lake Temple. He became a wonderful father to her two daughters, Shaun and Stacey. After one year in Little America, Wyoming, they moved to their present home. Dan had many Church callings: Gospel Doctrine teacher, High Priest Group Leader, Bishop's counselor, Branch President, (University of Utah Student Stake), Stake High Councilor, Stake Executive Secretary, Temple Worker. He has been a member of the Utah and California Bar Associations for 54 years. He served on the Salt Lake City School Board for 10 years, the last two years as President. From 1992 to 1998, he was attorney for the LDS Church in Europe, headquartered in Frankfurt, Germany. Two satisfying legal achievements were the securing of a full tithing tax deduction for Church members in Australia and Germany and the procuring of the title to the land for the construction of the Madrid Temple. He battled the United States Government for a period extending over 30 years for the wrongful death of southern Utah sheep resulting from nuclear fallout. He is survived by his wife, Miriam, and five children: Shonnie Passey (Robert), Centerville; Steven D. Bushnell (Paula Craig), Fallbrook, California; Susan Brown (Mark Coleman), Salt Lake City; Shaun Humphries (Stephen P.), Provo, and Stacey Segura (Thomas R.), Glendora, California. There are 18 grandchildren and seven great-grandchildren. Also he is survived by three brothers: J. Merrill Bushnell, Provo; Dr. Fred Bushnell, Laguna Niguel, California; and T. Darrell Bushnell, Orem, and many nephews and nieces and cousins who will miss him greatly. He loved and cherished his many friends. He wanted everyone to know that his family meant everything to him; his faith in God was complete; he didn't only believe, he knew. Funeral services will be held at the Federal Heights Ward (off Virginia Street), Monday, December 30, 2002, at 12 noon. The viewing will be held from 6 to 8 p.m. Sunday evening at Sunset Lawn, 2350 East 1300 South and from 10:30 to 11:45 prior to the services on Monday. He will be buried in the Salt Lake City Cemetery. In lieu of flowers, friends may donate to West High School Scholarship Fund or charity of their choice.

I worked as a legal secretary for Dan at the SLC firm of Kirton, McConkie, Boyer & Boyle in and about 1976-1979. We did litigation with Joseph C. Rust as well. It was such a good experience. I became an attorney myself in 1991 with an office in Northern California. I recently just thought of those days. Im sorry to hear Dan passed long ago now, but hes with our Lord. Thats good. Just had to say something.

I remember with fond memories my association with you and Dan while Garth Heiner and I owned homes in Federal Heights and lived there off and on for 20 years.

I had been home from my mission (Spain) for about a year and a half when Dan hired me away from the County Clerk's Office to work as the first Paralegal at what was then, Kirton, McConkie, Boyer & Boyle. The year was 1976. Dan knew my father, who was a long-time clerk at the Salt Lake County Clerk's Office. I remember how exciting it was to work with Dan and his small group of litigation attorneys- Dan treated all of us so well. Some of my tasks were to summarize depositions, help prepare exhibits, interview some witnesses. I was invited to sit at counsel's desk during some trials-- I remember one in particular in Federal Judge Ritter's Court with Cowboy Oil. I think Dan always stood up for the underdog. I also had the privilege of running some errands for Dan-- running stock certificates to Brokers and others. I helped with the building of his cabin in Mount Aire Canyon, and the attorneys and I in the litigation group had a golf game and steak dinner there. Dan always saw that I was included in the monthly luncheons at the Lion's House hosted by Bill Kirton.



I will always remember Dan for his kindness and consideration towards me, and for the opportunities he afforded me. I only remained with the firm for about two years, but his deameanor and influence on me are long-lasting. He truly was a mentor. I also remember how proud he was of his son, Steve, and the work Steve was doing with Cover Pools. I had the chance to meet Dan and Miriam several times over the years, most recently at the dedication of the Spain Madrid temple. My condolences to the Bushnell family.
